13 | On 06/10/21, Licensing Program Analyst (LPA) N. Cunningham met with Licensee Cabreros to deliver complaint findings. The meeting was conducted via tele-inspection due to the current pandemic. It is alleged that the licensee spanks a day care child and that the licensee mishandles a day care child. On 2/12/21, the licensee discussed the allegation with LPA O'Connell and denied both allegations. On 6/2/21 at 3:00pm, LPA Cunningham conducted a subsequent interview with the licensee who again denied the allegation. During the investigation, interviews were conducted with Adult 1 on 5/6/21 beginning at 1:20pm, Adult 2 on 5/18/21 beginning at 7:30pm, Adult 3 on 6/9/21 beginning at 12:07pm, Adult 6 on 5/19/21 at 10:52pm, Adult 7 on 5/24/21 beginning at 10:00am, Adult 9 on 6/7/21 beginning at 5:33pm, and Child 4. Interviews with parents, staff, and child did not provide corroborating evidence to meet the preponderance of evidence threshold standard and therefore the allegations are unsubstantiated. Licensee's signature is not on file, however, a copy of this Complaint Investigation Report (LIC 9099) was provided to Licensee; and confirmation of receipt is on file. There were no Title 22 deficiencies cited regarding the two allegations noted above. Appeal Rights were provided. |
