On 07/06/21, Licensing Program Analyst (LPA) N. Cunningham met with Program Supervisor, Hayshawn Frochi to deliver complaint findings. The meeting was conducted via tele-inspection due to the current state of emergency regarding the COVID-19 outbreak. It was alleged that Staff 1 handled a child roughly resulting in injury, specifically, applying a tight grip on a child’s wrist which caused a bruise. It was also alleged that Staff 1 spoke inappropriate in front of a daycare child, specifically, questioning an adult’s parenting skills. Lastly, it was alleged that Staff 1 discussed a child’s confidential information in the presence of others. Staff 1 denied all the allegations and noted that they were not on campus on the date that the allegations were reported to have happened.

During the investigation, interviews were conducted with Adult 1 on 06/18/21 beginning at 2:47pm, Adult 2 on 6/30/21 beginning at 11:56am, Adult 3 on 06/30/21 beginning at 4:25pm, Adult 4 on 06/30/21 beginning at 5:32pm, Staff 1 on 05/13/21 beginning at 2:47pm, Staff 2 on 05/17/21 beginning at 10:30am, Staff 3 on 03/22/21 and 05/28/21 beginning at 9:45am, Staff 4 on 07/01/21 beginning at 9:15am, Staff 5 on 06/18/21

beginning at 1:20pm, Child 4 on 06/30/21 beginning at 05:32pm, Adult 5 on 07/06/21 beginning at 2:30pm, Child 5 on 07/06/21 beginning at 2:35pm, Child 6 on 07/06/21 and beginning at 2:40pm. On multiple occasions, LPA attempted to interview Child 1 and Child 3.

Interviews conducted with four staff (Staff 2, 3, 4, & 5) and four parents (Adult 2, 3, 4, and 5) reflects that Staff 1 interacts and communicates with children in a positive manner. LPA attempted to interview Child 1, Child 3, Child 4, Child 5, and Child 6, however, LPA was unable to qualify the children.

Interviews conducted with three staff member (Staff 2, Staff 3, Staff 4) and four parents (Adult 2, Adult 3, Adult 4, and Adult 5) reflects that parents and staff have not observed Staff 1 discuss inappropriate content in front of children or discuss confidential information in front of others. LPA attempted to interview Child 1, Child 3, Child 4, Child 5, and Child 6; however, LPA was unable to qualify the children.

Interviews with parents, staff, and the facility management did not provide corroborating evidence to meet the preponderance of evidence threshold standard and therefore the allegations are unsubstantiated. Program Supervisor signature is not on file, however, a copy of this Complaint Investigation Report (LIC 9099) was provided to Program Supervisor; and confirmation of receipt is on file.

There were no Title 22 deficiencies cited during today’s tele-investigation. Appeal Rights were provided.
