Licensing Program Analyst (LPA) Elpidia Hernandez Torres conducted a subsequent tele-investigation Zoom video conference with Licensee Linda Hamner for the purpose of delivering a complaint allegation result finding. Due to COVID-19, the Department has suspended all field operations, and Licensee has agreed to attend a Zoom meeting with LPA. It is alleged that there was lack of supervision resulting in day-care child being bullied while in care. LPA Cunningham previously met with licensee via Zoom video conference on 12/18/20, and LPA discussed the purpose of the tele-inspection with licensee; and obtained a facility roster of the children currently in care.

LPA Hernandez Torres requested updated facility roster, staff contact information, and schedule from Licensee on 03/17/21. During that conversation, Linda Hamner denied the allegations and stated there is always one other adult helping with the day care, alluding to bullying isn’t a result from lack of supervision. Interviews with staff on 03/18/21, 03/24/21, and 03/29/21 corroborated the statement that there is always one additional staff providing care with the licensee.

On 03/23/21, LPA Hernandez Torres spoke to four parents who all stated they have never seen or heard of their child/children getting bullied while at the daycare. Furthermore, their statements corroborated there is always a minimum of two adults providing supervision over the children. One parent interviewed did make a comment that the potential for bulling is possible in the outdoor play area. LPA Interviewed children on 03/26/21, all stating there is always another staff member besides Licensee proving care. A few did notate bullying does occur between children, but that licensee or staff member will place the ‘bully’ on time out.
Based on interviews conducted and records reviewed, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, therefore the allegation is Unsubstantiated.

Licensee’s signature was not recorded on this Complaint Investigation Report (CIR), however, this report was reviewed and discussed with licensee. Licensee was provided with a copy of this CIR; and Appeal Rights, read receipt is on file. All licensing reports are public information and must be made available upon request for at least three years.
