A subsequent complaint investigation inspection was conducted at the facility by Licensing Program Analyst (LPA), Amy Strother to deliver complaint investigation findings. It has been alleged that staff handled child in a rough manner and that staff talks inappropriately to children in care.

LPA met with new center director, Jenna Vincent, (D1). An initial investigation visit was made by the LPA on 02/08/22, meeting with former director, Joelle Bonaudi. During the visit on 02/08/22, LPA requested and received a copy of the facility roster, personnel report, and a list of staff phone numbers. During the compliant investigation, LPA interviewed three staff, Staff 1 – Staff 3 (S1-S3) and six children, Child 2 – Child 7 (C2-C7) between 02/08/22 and 04/14/22. Interviews with C3-C7 and S3 corroborated that on more than one occasion they have witnessed a staff pull on the arm of a child(ren) in care in a rough manner, C3-C7 specifically stated that a teacher has put them or another child on a time out in the office or hallway and pulled their arm or pushed them to put them on a time out.

A subsequent complaint investigation inspection was conducted at the facility by Licensing Program Analyst (LPA), Amy Strother to deliver complaint investigation findings. It has been alleged that staff does not provide adequate supervision to children in care and that staff did not inform parent of child’s incident.
LPA met with new center director, Jenna Vincent. An initial investigation visit was made by the LPA on 02/08/22, meeting with former director, Joelle Bonaudi. During the visit on 02/08/22, LPA requested and received a copy of the facility roster, personnel report, a list of staff phone numbers and copies of accident reports and incident reports that had been written by staff. During the compliant investigation, LPA interviewed three staff, Staff 1 – Staff 3 (S1-S3) and six children, Child 2 – Child 7 (C2-C7) between 02/08/22 and 04/14/22. During the inspection on 02/08/22, LPA observed 15 children being supervised by a teacher and an aide, meeting the capacity and ratio requirements. No children were observed to be left unsupervised. All staff interviewed (S1-S3) denied that children are not supervised adequately, stating that children are supervised at all times.

Staff specifically stated that the environment is scanned regularly so they know where children are, staff use the Director to help supervise children in the bathroom when needed and that staff are stationed in specific areas of the play yard to cover supervision of all areas. Interviews did not corroborate the allegation that staff does not provide adequate supervision. All staff interviewed stated that reports are written when incidents involving injuries that leave marks occur. S1 and S2 specifically stated that they fill out incident and accident reports, stating that an incident report is used when a child did the hurting of another child or used inappropriate language. An Accident report if used when a child gets hurt or injured. The reports are copied, the facility keeps one and the other goes to the parent(s). LPA obtained copies of incident and accident reports during the inspection on 02/08/22. Interviews and record reviews did not corroborate the allegation that staff did not inform parent of child’s incident.
Based on available information, observations, record review and interviews conducted, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the allegations are unsubstantiated.

There were no Title 22 deficiencies cited based on the above findings. Exit interview conducted and report was reviewed with facility representative, Jenna Vincent. Appeal rights were provided

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Interviews with C4-C7 and S1 corroborated that on more than one occasion they have heard staff talk inappropriately to children in care, specifically that staff yell or say things in a mean way when angry or mad.

Based on evidence obtained, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. The following violations of the California Code of Regulations, Title 22: Division 12, were observed: See LIC9099D. Appeal Rights were provided.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

LPA Strother informed facility representative, Jenna Vincent that this report dated 04/20/22 documents two Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.

Also, LPA Strother informed the facility representative to provide a copy of this licensing report dated 04/20/2022 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
