A follow-up complaint investigation visit was made today by Licensing Program Analyst (LPA), Sebastian Phouthavong to deliver complaint investigation findings. LPA, Kevin O’ Connell previously conducted an initial investigation visit on 08/24/2022. It was alleged that the facility does not provide comfortable accommodations for daycare children, specifically that indoor temperature is over 85 degrees and the system not working well during past local fires or hot days. It was also alleged that the facility is in disrepair, specifically that fan coverings are falling off or not secured and that the outdoor grounds poses as a risk to the daycare children, specifically the fence is falling down and tripping hazards in the play yard.

The LPA met with the facility’s site director, Alejandra DeLacruz today to discuss the investigation findings. The facility was toured inside and out, and LPA observed six children being supervised by five staff members.
During the course of investigation, LPAs conducted interviews with the site director, four staff members, and four parents. (Continued on LIC 9099)

The director and staff denied the allegations, stating that they have never observed the temperature to exceed over 85 degrees and that the facility’s fans have never been in disrepair or had the fan covers fall off. The director stated the facility's building is old and has plan to update it. The director and staff members also stated that the outdoor fencing has been in good condition, with no tripping hazards in the yard.

Parents were interviewed on 11/04/2022 and 11/14/2022. Two parents expressed no concerns with the facility while two other statements indicated that the facility could use some maintenance, noting the facility equipment not working well, and the outdoor area not being in good condition. LPA's investigation did not corroborate that the facility is in disrepair and does not pose a risk to children in care at this time.

Based on the information gathered during this investigation, there is not a preponderance of evidence to support the allegation. The allegation is determined to be unsubstantiated. There were no Title 22 deficiencies cited. his report was reviewed and discussed with the facility’s director, Alejandra DeLacruz. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit
