32 | The LPA interviewed 1 out of 1 (C1) children on 8/11/22. C1 indicated not remembering if the parent made any comments to “suck it up” before coming to the day care, nor if C1 had made the statement first to the staff, however, the child does remember the Site Supervisor making the statement. The LPA interviewed 2 out of 2 staff on 8/11/2 and 8/12/22, none of whom remember the Site Supervisor or child making any comments of that nature.
The LPA has determined that the Site Supervisor acknowledged making the comment. Whether the Site Supervisor was repeating what the child said or not could not be determined, regardless the statement was not appropriate.
Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated.
The following violation(s) of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 809D. Appeal Rights were provided and an exit interview conducted with Lori Furtado.
