An unannounced inspection was conducted by Licensing Program Analyst (LPA) Steven Tung on 9/27/22. A risk assessment was conducted, and appropriate PPE was used. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 7/21/2022. LPA met with Assistant Director Geovana Hernandez to whom the purpose of the inspection was announced.

Throughout the course of the investigation, interviews were conducted with staff, children, and parents. LPA also reviewed and obtained copies of class rosters, children’s rosters, incident reports, teachers’ emails and notes, children’s records, and a doctor’s note.

Complaint alleges that staff are not preventing inappropriate interactions between day care children. Complaint also alleges that unusual incidents involving day care children were not reported.

LPA obtained additional details regarding allegations during interview with the complainant. Child #2 (C2) was seen by C2’s doctor and C2’s doctor did not disclose any concerns. Complainant also disclosed that C2 complained about pain at beginning “maybe April and definitely May.”

Regarding allegation #1 Staff are not preventing inappropriate interactions between day care children, LPA conducted interviews with the complainant, children attending the facility, staff, and parents. There were no disclosures made by children.

Staff disclosures were consistent in that they have not observed any adult or child inappropriately touching another child at the facility and they have not received a report of any adult or child inappropriately touching other children at the facility.

During parent interviews, statements corroborated that they do not have any concerns with the facility and that their children enjoy attending the daycare.

This agency has investigated the complaint alleging staff are not preventing inappropriate interactions between day care children. Based upon the evidence as presented above, the allegations have been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegations may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegations are unsubstantiated.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. An exit interview was conducted with Assistant Director Geovana Hernandez.
