32 | Regarding the allegations of proper staff-child ratios are not maintained at all times, Facility staff being unqualified and staff leaving daycare children unattended. During interviews, it was disclosed that the director did not provide coverage or assistance to staff who needed to step away to utilize the restroom or take breaks. After the staff made the director aware that they needed assistance, the facility’s director instructed the staff to remain in the classroom. Per Staff, Director refused to assist staff after being informed of the situation. This resulted in staff having to leave the children unattended. LPA observed the facility’s operation on April 12, 2023 and obtained the staff schedules. It was discovered that the facility has limited staff to allow for staff emergency breaks and lunch. LPA observed that staff #5, hired as a teacher, was scheduled by the director to leave at 12 pm, leaving staff #2, hired as a teacher aide, alone to care for the remaining children. The regulation states that an aide shall work only under the direct supervision of a teacher.
Regarding the allegation, staff with signs of illness provide care and supervision to daycare children. During this investigation, disclosures were made that staff informed the director of having signs of illness; however, they were instructed to remain at the facility to care for children, which posed a risk to the health and safety of the children in care.
Based on LPA’s observations, interviews conducted and record reviews, the preponderance of evidence standard has been met, therefore, the above allegations are found to be substantiated. California Code of Regulations (Title 22 Division & Chapter), are being cited on the attached deficiencies page LIC 9099-D.
An exit interview was conducted with the Director and was provided a copy of their appeal rights (LIC 9058), and their signature on this form acknowledges receipt of these forms.
The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site inspection by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
Upon receipt of this report, the licensee shall post ANY licensing report documenting a type “A” citation. This must remain posted for 30 days during hours of operation. In addition to posting this report, the director will provide copies to the parents of the children in care for up to one year. A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was explained and provided to the Director. Page 2of 2 |
