On 02/20/2020 at 12:35pm, Licensing Program Analyst (LPA) Denise Miranda arrived at Temple Judea School located at 5429 Lindley Avenue, Tarzana, CA 91356 for the purpose of investigating the above-mentioned allegation. LPA met with Lisa Whitman, Director, and discussed the purpose of the visit. There were 89 preschool in care being supervised by 19 teachers, 3 teachers assistant and Director.
Based upon the evidence obtained throughout the course of investigation which include interview with relevant parties, and records review, and observation of facility operation, it was concluded that there is a preponderance of the evidence to support that the alleged violation occurred.
On 09/20/2017 Facility granted the waiver to allow an armed guard on campus. The facility did not follow the waiver condition: The individual carrying the firearm must undergo and clear a background check by the Community Care Licensing Division prior to employment or stationing at the facility.
LPA observed individual#2 has not been associated to facility personnel. Therefore, the allegation is deemed Substantiated. Substantiated - A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standard has been met.

Upon receipt of the Type A Violation(s), licensee shall post the report for 30 days in addition to the Notice of Site Visit, provide copies of the licensing report to parents/guardians of children in care at the facility and obtain a signed Acknowledgement of Licensing Reports (LIC 9224) from parent/guardian & place it in each child's file by the close of business the following day or the next day child returns to the facility. The same report must be provided to parents/guardians of children newly enrolled at the facility during the next 12 months & licensee will obtain a signed Acknowledgement of Licensing Reports (LIC 9224) from parent/guardian & place it in each child's file. If these requirements are not met, civil penalties in the amount of $100 per violation will be assessed.

The facility was made aware that a licensee may file an appeal, in writing 15 business days from the date of receiving the penalty assessment.

The following deficiency was observed in accordance to Title 22 of the California Code of Regulations and Health and Safety Codes during this inspection. Please refer to 809-D for documentation of deficiencies.
LPA provided the LIC9224 Acknowledgement of Licensing Reports to Director.

A copy of this report, Acknowledgement of Licensing Reports (LIC 9224), appeal rights were provided to the Director and an exit interview was conducted.

Center Director was informed that individual #2 is not allowed to access the facility until obtain a criminal record clearances or exemptions. Director provided a letter that per title 22 facility will follow the waiver conditions.

Based on LPA, observation and records reviewed on 2/120/2020, this requirement was not met. Individual# 2 has not been associated to the facility. This is a Type A citation and poses an immediate risk to children in care.

Director shall provide a parents/guardians a copy of the report dated 2/20/2020 with copy of LIC9224 Acknowledgement of Receipt of LIcensing Reports and mantain a copy of LIC9224 form in children's file.
