On 4/22/2022 Licensing Program Analysts (LPAs) Deborah Lowe and Suzette Ornelas, conducted an unannounced Annual Required Inspection for the preschool license. Upon arrival LPAs were met by facility representative in the office, a second facility representative arrived at 8:10 am and began a tour of the facility. Days and hours of operation are Monday – Friday 7:30 am – 6:00 pm.

LPAs requested to see the room the children were currently occupying, facility representative led LPAs through the office where one staff member was standing in, then to the computer room where the children were. At 8:15 am LPAs observed 2 preschool children unsupervised in the computer room with 5 of the private school elementary children. This observation will result in 2 Type A citation. The teacher/ facility representative leading the tour took supervision of the 2 preschool children and went to Room 4. Facility representative in office took supervision of the private school elementary children. Combining preschool children and private elementary children together is operating beyond the conditions and limitations of the license.

Director arrived at about 8:00 am. LPAs then met with Director, Sandy Smith, and continued to tour the facility indoors and outdoors.

Facility is currently only using Room 4 for care and supervision. Rooms 2 & 3 are set up for use and available for children and staff. Director stated Rooms 1, 5, 6, & 7 are not in use by children or staff.

There is an in-ground swimming pool that is fenced per regulation to make it inaccessible. The pool gate is self-latching, self-closing and opens away from the swimming pool. Swimming pool is not used for preschool children. Pool use is for the private elementary school only. There are no firearms or ammunition allowed or stored on the premises. Disinfectants, cleaning solutions, medication and other hazardous items are made inaccessible. Pesticide poison was observed in a child’s classroom restroom inaccessible to children but not observed in a locked storage area. Director removed and placed in a locked cabinet during visit.

Furniture and equipment are in good condition, free of sharp, loose or pointed parts. Outdoor Playground located in front of Room 4 is only playground in use by preschool. Backyard playground Director stated is not in use. One piece of wooden playground equipment was observed in need of repair. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. All toilets and handwashing facilities are in safe and sanitary operating condition. Floors in the facility are clean and safe.

All kitchen, food preparation and storage areas are clean, free of litter/rubbish and free of rodents/vermin. All food is protected against contamination and any contaminated food is discarded immediately. Solid waste storage containers located in the bathrooms are in need of tight-fitting covers. Drinking water is available both indoors and outdoors.

Areas around slide and spring riders have cushioning material to absorb falls. The facility is free of flies, insects and rodents. Facility is in need of one or more functioning carbon monoxide detectors that meet statutory requirements.

Capacity as specified on the license is being maintained. Facility is in need of at least one person trained in CPR and Pediatric First Aid present when children are at the facility or at offsite activities. Review of staff records show staff CPR/First Aid has expired. The name of the child care center director or fully-qualified teacher designated to act in the director’s absence has been reported to the Department. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. Facility maintains a ratio of one teacher supervising no more than 12 children in care.

LPAs reviewed a sample of children’s files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child and medical assessment. LPAs review of staff files and observed files were complete with health screening, immunization records for influenza, one file reviewed is in need of pertussis and measles. Files reviewed were in need of current documentation of completed mandated reporter training. Menus are posted at least one week in advance where an authorized representative can view them.

Incidental Medical Services (IMS) are not currently being provided. Licensee is aware that an IMS plan is required to be submitted to the licensing office if they provide any of these services. The following items were discussed:

Licensee was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see next page, 809 D)

Licensee was provided a copy of their appeal rights.

LPAs Deborah Lowe and Suzette Ornelas informed Facility Representative Sandy Smith that this report dated 4/22/2022 documents 2 Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk to the health, safety, or personal rights of children in care.

Also, LPAs Deborah Lowe and Suzette Ornelas informed the Facility Representative Sandy Smith to provide a copy of this licensing report dated 4/22/2022 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
