32 | LPA conducted interviews with facility staff members from all the classrooms. There were two disclosures made of staff being out of ratio where a staff member is alone with more than 12 children. One disclosure was described as the staff member being alone with more than 12 children when the assistant staff walks out of the classroom to grab an item located outside of the classroom. Another disclosure came from a staff member who described that during naptime there can be around 22 children alone with the staff member which the staff is still in compliance with of teacher-child ratio. Yet, the staff member described that when children begin to wake up, the assistant staff will not arrive on time, leaving the staff member alone with 22 children waking up.
Based on LPA’s interviews which were conducted and complainant's reported observation, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Section 101216.3, are being cited on the attached LIC 9099D.
Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months.
Exit interview conducted and a copy of this report was left with Sister Celine. A copy of the appeal rights were provided and explained.
A "Notice of Site Visit" and copy of the report was issued. Notice of Site Visit must remain posted for 30 days. Failure to do so will result in a $100.00 civil penalty
This report must remain on file for three (3) years. This report must be posted for 30 days in clear view, at the entrance of the Hayden Child Care Center. The report can not be covered/concealed.
