-Pertaining to the allegation that “Provider inappropriately disciplines children in care”: this refers to an allegation that licensee forces children to sit down in the hallway as a form of punishment and/or are hit with a fly swatter or are threatened to be hit with a fly swatter If they don’t listen or sit down and be quiet while watching TV.
Licensee acknowledged having children sit or stand in the hallway as a form of discipline. As licensee or her assistant are able to see the children while they are in the hallway, this in and of itself is not a violation. However, interviews conducted revealed that younger children may be hit with a belt or back scratcher kept in licensee’s bedroom or with a fly swatter nicknamed “Pink Buggy” or “Pink Becky,” which is kept in the TV room; older children are forced to sit down or stand in the playroom, made to look at toys they are not permitted to play with, or are forced to sit or stand in the hallway, facing the wall. This is a form of humiliation, which is a violation. If children know and understand that they are standing in the hallway as a form of punishment, then the others know why they are standing there and that is humiliating.
According to licensee, she has the children sit or stand in the hallway for 5-10 minutes; according to interviews conducted, the children are made to stand up for as long as licensee wants, and are threatened with the fly swatter if they state that they are tired of standing. This form of discipline is not permitted since it violates the personal rights of children. Being made to sit or stand in the hallway is a form of humiliation. Being threatened to be hit with the fly swatter is a form of intimidation and is also a violation of the children’s personal rights.
Observations made by witnesses corroborate that children sit in the bedroom and watch TV the duration they are in care and that children may be forced to sit or stand in either the hallway or the playroom as a form of punishment. |
