A complaint investigation was conducted by Licensing Program Analyst Mireya García for the purpose of investigating the above allegation. LPA met with Marcia Cagigas, Diretor and Jacqueline Zavala, Vice Director who guided analyst on a tour of the facility. Census was taken.

LPA interviewed staff, obtained declarations and took pictures on the restroom which is located in between the “orange” and “yellow” classrooms. The restroom is accessible from the “orange” classroom and from the “yellow” classroom. LPA learned on 07/30/19 child #1 was left unsupervised in an empty classroom. Children and staff were in the “orange” classroom when child #1 was discovered missing. When the grandparents of child #1 arrived to pick up the child, staff were unsure of child’s whereabouts. Approximately one (1) minute later, child was discovered in the yellow empty classroom playing in the dinosaur counter area which is located near the restroom entrance/exit door (“yellow” classroom side).

Staff disclosed the child was able to access the empty "yellow" classroom due to the restroom being accessible from both classrooms (Orange/Yellow). The door leading to the restroom from the "orange" classroom is left open so children can freely access the restroom.

Based on LPA review of documentation and interviews conducted, declarations obtained during today’s inspection, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, Title 22, Division, 12, Chapter 1, Article 06, Section 101229(a)(1) Care and Supervision, relating to this allegation have been cited on 08/14/2019 on LIC 9099-D.

Exit interview was conducted with the Director, Marcia Cagigas. The Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these forms.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site inspection by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

Director submitted to LPA a declaration to ensure future compliance during today's inspection. All staff training on care and supervision will be taking place on 08/21/19, Per Director she will submit training agenda/sign in sheet via email to LPA no later than 08/23/19.

This requirement is not met as evidenced by LPAs review of documentation and interviews conducted, declarations obtained during today’s inspection reveal that child #1 was left unsupervised in a classroom before being found. This poses a potential health and safety risk to children in care.
