An Informal Office meeting was conducted today to discuss concerns the Department has regarding the above facility. Present at this meeting was, Administrator, Chris Tortoci and Teresa Figueras ( Director for Child Development program) Adriana Hernandez, Licensing Program Manager and Ketki Desai, Licensing Program Analyst (LPA).

The following was discussed due to Deficiencies (Type A) cited during Case Management (Incident) inspections conducted on 2-13-19 and 5-10-19

· California Title 22 Regulations 101229(a)(1) - Care and Supervision. No child(ren) shall be left without the supervision, including visual observation, of a teacher at any time. The licensee was cited on 2-13-19 due to the following: Care and Supervision: This requirement is not met by evidence of incident occurred on January 25th, 2019, where child#1, sustained an injury which wasn't witnessed by any of the staff members present at that time. This poses an immediate risk to Health and Safety to the children in care.

· California Title 22 Regulations 101226.3(b): Observation of Child: Care and Supervision: Observation of the Child: Any unusual behavior, any injury or signs of illness requiring assessment and/or administration of first aid by staff shall be reported to the child's authorized representative and recorded in the child's record. This requirement is not met by evidence of Staff member failing to report the sustained fall by child to the authorized representative and the School Director present on site but left the facility without any notification. Parent took the child to the Facility Director. This poses an immediate risk to Health and Safety to children in care.

· California Title 22 Regulations 101229(a)(1): Responsibility for Providing Care and Supervision: No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met by evidence of incident occurred on April 16th, 2019, where child # 2, sustained an injury and staff member present at that time did not report the incident to school Director and Authorized representative. This poses an immediate risk to Health and Safety to the children in care.

· California Title 22 Regulations 101223(a)(2): Personal Rights: To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met by evidence of Child # 2, sustaining a fracture at the school playground. This poses an immediate risk to Health and Safety to the children in care.

Chris Tortoci, Director was advised the facility has to be in compliance at all times. No Administrative Action will be taken at this time.
The following plan currently is being implemented by the facility to ensure Health and Safety of children in care is maintained at all times.
(1) Additional safety measures have been implemented in the play yard
(2) Introduction of monitored and structured activities
(3) Zoning training in place.
(4)The three year old have moved to a smaller play yard and four year old children have moved to a bigger yard.
(5) Scheduled play time for each classrooms
(6) Structured Sign out procedure in place and the staff is not counted in the ratio for additional safety
(7) Facility focusing to ensure, that parents are adhering to their Contract timing so the ratio's are maintained
(8) Staff are made aware of reporting requirements.
(9) Department have also shared an additional online training for staff. (Smarthorizons- Early Childhood Education)
(10) Additional Educational training for newly hired Child Development technicians and Sub teachers.
(11) FACILITY IS PLACED ON A REQUIRED ANNUAL INSPECTIONS FOR THE NEXT TWO YEARS.
Exit interview was conducted. No deficiencies were cited during this office meeting.
