An unannounced inspection was conducted by Licensing Program Analyst (LPA) Roxana Lopez on 7/28/2023. A risk assessment was conducted. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 05/08/2023. LPA met with Program Director, Rebecca Jimenez Barlow to whom the purpose of the inspection was announced. Census was taken.

Throughout the course of the investigation, interviews were conducted with staff, parents and 1 child. LPA also reviewed and obtained copies of the current children’s roster and other documentation.

Per the initial complaint report, the Reporting Party (RP) reported that their child and other children in the center have been getting hurt by a classmate. A recent incident included a child being choked. Per Reporting Party all incidents have been reported to the site administration and teachers have provided as much support as possible, but Director has not provided parents with a solution.

Regarding allegation: Staff is not providing adequate supervision to the daycare children while in care: LPA conducted interviews with 3 Staff. Staff #1 -3 corroborated that children have been hurt by the same child. Per Staff # 3 the choking incident occurred outside on the playground- child # 1 was playing on a bike, left bike and went across the yard to play in a tunnel. Minutes later as child # 1 was coming out of the tunnel, child noticed that the bike they were using was being used by other children. Child # 1 became upset and ran across the yard, hitting other child and putting hands around the neck of the other. Per Staff # 3 staff were present, observed the incident but were not able to prevent the incident. Staff # 1-3 corroborated that classroom has additional support daily, including a disability specialist, shadow to support the classroom needs. .

LPA reviewed documentation which documents various incidents throughout the days from February- June involving child # 1 hurting other children or being unsafe. Incidents document, staff being present and unable to prevent incident. LPA also reviewed the schedule and plan of the shadows, extra support and additional training for staff.

During parent interviews, a parent disclosed that their child is continuously being hurt , no dates provided. Per parent, they met with Director. Mr Rivera who did not give specific plan on what was going to be done and Director offered to move their child to a different classroom. Per Parent, they declined the offer.

During interview with child # 2, they disclosed that child # 1 did hurt their bodies on different occasions.

This agency has investigated the complaint alleging staff are not providing adequate supervision to the daycare children while in care. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

A notice of site visit was given and must remain posted for 30 days.
