Licensing Program Analyst (LPA) Jeanette Estrada conducted an unannounced case management inspection due to an incident that was reported to the Department. LPA met with Director Debra Ward. There were 57 children present during today's visit. Children were napping upon LPA's arrival. Ratios were observed to be in compliance. In group 1 there were 13 children and five teachers, group 2-14 students and three teachers, group 3-12 students and two teachers and group 4-18 students and 2 teachers.
LPA conducted interviews and obtained documentation during this visit. The incident occurred on 10/27/22 and was reported to the Department on 10/28/22 via email. The incident involved Child 1 who sustained an injury that required medical treatment from a medical professional. Per the Unusual Incident Report that was submitted, Child 1 was walking quickly toward the hummingbird garden as a basketball rolled toward them. Child 1 stepped on the basketball and fell landing on their left arm. Per staff interviews conducted on 12/8/22, Staff 1 was standing next to Child 1 when the incident occurred. Other children were playing with the basketball and the basketball hoop next to the ocean area. Child 1 was walking back and forth throughout the area. Staff 1 described that the basketball rolled toward Child 1 perpendicular to Child 1 as they were walking. Per Staff 1, Child 1 fell with their body weight on their arm. Staff 1 assisted Child 1 and inquired about the pain to identify where it was coming from. Child 1 pointed at their arm. Child 1's parent was notified when the incident occurred and ice was applied to Child 1's arm as they were waiting to be picked up. Parent took Child 1 to be evaluated and Child 1 was given a cast. LPA reviewed medical paperwork which stated that no fracture was identified. Child returned to the facility and the staff provided accommodations for the child. Per Staff 1, they have now moved the basketball court from the walking path next to where the incident occurred. They have moved it to a less crowded area and the activity will be supervised by a teacher. Based on interviews and record review, the staff provided first aid and notified the parent in a timely manner. The facility reported the Unusual Incident to the Department within the required 24 hours of occurrence. LPA determined there will be no deficiencies cited at this time, per California Code of Regulations Title 22, Division 12. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative.
