Licensing Program Analyst (LPA) Seung Lee conducted an unannounced complaint inspection. Upon arrival LPA Lee met with Director Pam Deem.

During the course of this investigation, LPA conducted interviewes, reviewed documents, and made observations in regards to the above allegation.

The complaint alleges that the a lack of adequate supervision resulted in a child in care sustaining injuries. The facility denied this allegation and made no disclosure. The reporting party specified that Child#1 sustained multiple injuries at the facility during the month of September. The reporting party stated that although the facility did provide the parent of Child#1 with incident reports for the injuries, there was no explanation of how the injuries occurred. During a file review for Child#1, LPA Lee observed a total of 4 incident reports created in the month of Septembr. Three incident reports out of the four did have an explanation on how Child#1 sustained their injuries.

One report out of the four did not have a specific explanation on how Child#1 sustained an injury which caused a mark on their cheek. The details of this particular incident report stated that there was a red mark observed on Child#1's face. During interviews conducted with Staff members, LPA Lee was not able to obtain any additional information regarding this specific incident report. While it is possible that Child#1 sustained an injury due to a lack of supervision, one incident report that stated a mark was observed on the child's face is not a clear indication that a child sustained an injury. It is possible that the mark was came from an interaction with another child, the child scratching or touching their own face, or the child falling or bumping into something. The fact that 3 out of the 4 incidents provide an explanation on how Child#1 sustained their injuries does indicate the facility providing some level of supervision. It is possible that a child in care sustained an injury at a facility despite having proper teacher to child ratio in the classroom and adequate supervision was being provided For example, if a child were to sustain an injury due to another child biting them, a staff member could have witnessed this entire interaction but was not able to physically prevent the interaction due to not being close enough to the two children.

Based on the evidence collected during the investigation, the allegation that facility staff does not ensure supervision is provided to children in care resulting in child sustaining injuries at the facility may be valid. However, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore at this time the allegation is found to be unsubstantiated.

The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain posting will result in a civil penalty of $100.00 dollars.
