On 07/22/2021 at 8:35am, Licensing Program Analyst (LPA) Adrian Risher conducted a complaint subsequent visit regarding the above-mentioned allegation. Upon arrival, LPA met with Yadira Villalobos, Director. LPA explained the purpose of the inspection. LPA toured the facility with Yadira Villalobos at 8:45am and observed 21 kids in care with 4 staff on the playground.
On 06/10/2021, LPA conducted the 10 day visit and interviewed the Assistant Director and 3 staff. LPA received the personnel report in person. The roster was provided via email by the Director. Staff 1 &3 stated that they use a kangaroo chart for discipline and behavior. The Assistant Director stated that they communicate with the children and give them time to think about what they did.
The Assistant Director stated that the staff stand at the door of the bathroom. One teacher takes the girls and the other teacher takes the boys. The teacher stays with the children until everyone is done. Staff 2 stated if they need more assistance then the staff will go into the bathroom with them. LPA observed the children lined up in the hallway during the bathroom time with staff waiting at the entrance of the bathroom.

On 07/22/2021, LPA conducted a subsequent visit to interview the Director and Child 1-6. Director stated that the discipline policy is the staff talk to the kids about rules and consequences. Staff give the children time to think about what they did. Child 1, 3, 4, 5 & 6 stated that the teacher puts the child on time-out if they are not behaving or listening. Child 5 stated the teacher tells them to be nice and share.

Director stated that there are usually 2 teacher in each classroom. One teacher will take a child to the restroom while the other one stays in the classroom. Child 1 stated the teacher stays near the bathroom while the children are using the bathroom. Child 3 stated that the teacher takes the girls and the helper takes the boys to the bathroom. Child 4 stated that the teacher stays next to the bathroom door. During the visit, LPA observed the children lined up in the hallway near the restroom with the staff waiting at the entrance of the restroom.

Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the above alleged violations did or did not occur, therefore the allegations are found to be unsubstantiated. The investigation regarding the allegations that staff hit a child and staff did not provide adequate supervision for children in care has been completed. It has been determined that the facility is not in violation of Personal Rights or Lack of Supervision requirements. No deficiencies will be issued.

Exit interview was conducted and a copy of the report was provided. Appeal rights were reviewed and provided. A plan of correction was discussed and provided to the Licensee.
