On December 20th, 2019, Licensing Program Analyst Lisa Rios (LPA Rios) went to the First Years Preschool to conduct an Annual Random Inspection. Upon arrival, LPA Rios was greeted by Narcisa Numic (teacher, S1) who has worked at the preschool for 24 years. LPA Rios was given a tour of the facility inside and outside and the following was observed:

Inside is made of of two classrooms, The Bears and The Penguins. The Bears have 16 children enrolled and come at 8:00AM. The Bear classroom has lots of age appropriate toys, heating and cooling system, skylights, a working telephone, a fire extinguisher serviced on 4/12/19, a first aid kit, a rabbit in a cage, a loft and tables and chairs for snack. There are 2 teachers in this room and all staff have finger print clearances.
The bathroom is large and accessible from both The Bear Classroom and The Penguin Classroom. The bathroom consists of 2 toilets, 2 sinks each with hand soap and paper towels. There is a changing table next to one of the sinks and shelves with baskets that are labeled with the children's names and contain diapers and wipes. Bleach wipes are located in a cabinet above the sink and inaccessible to children and there are shelves under the sink and changing table that contain extra diapers and extra clothes. In a corner by the door to the Penguin Classroom, there are shelves that store folded napping mats that are 2' thick. In the children's labeled baskets are their sheets and blankets.
In the Penguin Classroom (which is located in the front of the house), there are more age appropriate toys, tables and chairs for lunch and snack, a loft, plenty of light and ventilation, heating and cooling system and lots of labeled cubbies for children's belongings. There is a first aid kit also in here with a fire extinguisher serviced on 4/12/19, all required postings and access to the bathroom and kitchen.
The kitchen is accessed from both the front classroom (The Penguins) and the office that lies at the back.
The kitchen has a stove, microwave, refrigerator and cupboards. Snack for the day has been set out. There are plastic baggies with medication and children's names are clipped to the wall. A review of children's files shows that two have consent forms for the OTC medication.

Outside is a large yard that is accessible from both the office and The Bear Classroom. The yard has a large storage room (garage) with paints and age appropriate toys. There are 3 tables for the children to eat at, running filtered drinking water with cups is accessible to the children, a play yard with sand, swings with sand underneath and an age appropriate climbing apparatus with sand underneath as well.

LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records.

The following was discussed with the Director:
Senate Bill (SB) 792: This bill, commencing September 1, 2016, prohibits a person from being employed or volunteering at a child care facility or family day care if he or she has not been immunized against influenza, pertussis and measles.
Mandated Reporter: Beginning on January 1, 2018, AB 1207, requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Volunteers are encouraged but not required to take the training. Website: www.mandatedreporterca.com

Update on Incidental Medical Services: Facilities that provide Incidental Medical Services (IMS) must identify those services in their facility’s Plan of Operation and submit an updated Plan of Operation to the Department. Incidental Medical Services Include: Blood-Glucose Monitoring for Diabetic Children, Administering Inhaled Medication, Administering EpiPen Jr. and EpiPen or other Epinephrine Auto-Injectors, Glucagon Administration, Gastrostomy Tube Care (G-tube care), Insulin Injections Administration, Anti-Seizure Administration, and Emptying an Ileostomy Bag.
This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records.

Assembly Bill (AB) 2084: Health Beverages in Child Care: Commencing in 2010, legislation was established regarding nutrition standards for beverages served in licensed child care centers and home. Only unflavored, unsweetened, nonfat (fat free, skim, 0%) or low-fat (1%) milk can be served to children over two years of age. No beverages with added sweeteners, natural or artificial, can be served, including sodas, sweet teas, juice drinks with added sugars, flavored milks and diet drinks. A maximum of one serving (4 to 6 oz. for 1 to 6 years old) of 100% juice will be allowed per day. Clean and safe drinking water must be available at all times, including meals and snacks.

New Appeal Process: A licensee may file an appeal, in writing 15 business days from the date of receiving the penalty assessment. All appeals must be sent to: California Department of Social Services | Community Care Licensing Division, 300 N. Continental Blvd. Suite, 290-A, El Segundo, CA 90245.

Senate Bill (SB) 277 New Immunization Requirement: Beginning January 1, 2016, personal beliefs exemptions will no longer be an option for the vaccines that are currently required for entry into child care or school in California. Personal beliefs exemptions already on file will remain valid until the child reaches the next immunization checkpoint.

Licensee was made aware of The Child Care Advocate Program (CCAP) that is administered from within the Community Care Licensing Division. CCAP participates in many community activities and special projects in order to disseminate information on the State’s licensing role, provide information to the public and parents on child care licensing, and provide many other helpful resources to the licensees and the public. The facility was found to be not in compliance per Title 22 regulations and Health and Safety Code, Type B deficiency will be cited today 12/20/2019 under Health and Safety Code 15696.7995 and a Type A violation under Title 22 regulation section 101229 (a) (1).



A copy of this report along with a Notice of Site Visit were issued and explained to Director. An exit interview was conducted.

Based on observations, a child was sent to the bathroom alone and was in the bathroom with the door shut and called out for help two times. No teachers were present and no teachers had visual contact with the child. LPA Rios heard the child calling.
