On 01/24/2023 at 7:45 AM, Antonio Almanza, Licensing Program Analyst (LPA), conducted an unannounced site visit for the purpose of delivering findings for complaint allegations received by the department on 11/03/22, associated to Complaint Control Number 58-CC-20221011083119. LPA met with CHRISTINA EVANS, Director/Owner, and explained the purpose of the visit. During today’s visit there are 3 adults providing care to 13 children.

During the course of the investigation, LPA Almanza conducted Interviews and reviewed records regarding the aforementioned allegations.

Allegation, Day care child sustained unexplained bite marks.

According to the allegations submitted by the Reporting Party (RP), on Monday 10/31/22, the RP was bathing Child 1 (C1), when RP noticed more than 20 bite marks on the child's back. pg 1 of 4

The RP disclosed to LPA that on Monday evening, RP observed more than 20 bite marks on C1s side and that they were received while in care at the day care center. RP informed LPA that on Wednesday (11/02/22) morning C1 was taken to the hospital for the bite marks and the Doctor said they were bug bites.

According to written statement from Adult 1 (A1), Child Development Specialist with Crystal Stairs, When Staff 4 told the Parent (P1) of C1 to take C1 to the doctor, P1 said no because they would take the child away. P1 said that the reason C1 had bumps was due to their carpet at home. P1 then said that the bumps came from mosquitos when C1 was present at the school’s harvest festival on 10/28/22. A1 observed the bite marks were very close together on C1s stomach. The bite marks did not look like mosquito bites which is why P1 was advised by S4 to take C1 to the doctor.

Staff 4 (S4) is reporting that on 10/02/22, during the morning, P1 told a teacher and Child Development Specialist with Crystal Stairs that C1 had mosquito bites on the stomach and showed them the child’s stomach. S4 told P1 that for the safety of other children, P1 had to bring a doctor’s note to make sure it was not contagious.

Staff 3 (S3) is reporting that the week prior to 10/02/22, S3 opened the door and P1 asked about the insect bites on C1s stomach and said they came from the facility. S3 informed P1 that S4 would be notified. S4 explained to P1 that C1 had to be taken to the doctor.
Staff 2 is reporting that S4 asked P1 to take C1 to the Doctor to make sure the bumps were not contagious. P1 asked S4 to write a note so that housing could have P1s carpet cleaned because S4 thought it could be bed bugs. S4 told P1 that they needed a note from Pediatrician to rule out bed bugs.

RP was unable to provide LPA with photographs of the bite marks or a phone number where LPA could make contact with the P1. After considering the available information, LPA is unable to corroborate the allegation, Day care child sustained unexplained bite marks.

Allegation, Facility staff had inappropriate interactions in front of children.

According to the Allegations, when P1 arrived at the facility, S4 asked P1 to leave. P1 asked why was C1 being suspended and if it had something to do with the bite marks.

S4 dragged P1 into the office and began fighting with P1 in front of C1 and other children who began crying and screaming.

Staff 1 (S1) is reporting that on the last day that C1 was in care, P1 was really upset during pick up, told S4, give me my child in a deep angry voice. S4 was at the door when P1 pushed S4. P1 screamed S4 is pulling my hair, but S1 did not observe S4 do that or hit P1. C1 was next to S4 and S4 was protecting C1 from P1. P1, C1, and S4 where the only ones in the classroom during the incident.

Staff 3 (S3) is reporting that on 10/02/22, P1 talked to S4 over the phone regarding C1 having to go to the Doctor and Late pick up fees. P1 did not want to cooperate or obey the rules and policies so S4 told the parent that C1 could no longer attend the Child Care Center. P1 kept calling back asking to speak to S4 and told S3, I know you are S4. S4 received a call from Head Start and was told to call the police because P1 was on there way to the facility, but does not know why S4 was told to call the police. Parents where called to pick up their children. S3 was at the side gate releasing children to parents when she heard, rumbling, things falling, and screaming. S3 went to the front door, the front door was closed and when staff opened the door, she stepped in between P1 who was sitting on the floor crying and yelling and S4 who was on the other sides of the room. P1 was repeating “why, why can’t we stay”. S3 did not observe any fighting, or children in the classroom or kitchen area next to the classroom where the incident occurred.

Staff 4 (S4) is reporting that she received a call from P1 notifying the facility that she was running late to pick up C1. S4 told P1 that late fees would be due for late pick up. As a result of S4 going back and forth with P1, S4 told P1 that C1 would not be accepted back to the child care center. S4 was contacted by Crystal Stairs and notified to call 911 because P1 was on her way and made threats against S4. S4 was releasing children to parents when P1 arrived. When S4 gave a cover over to the parent, the parent pushed S4 and they started struggling. S4 thought P1 had a weapon. S3 got in between them. The police arrived and had to pull P1 out. S4 does not think there were children in the classroom.

According to written statement from Adult 1 (A1), Child Development Specialist with Crystal Stairs, When A1 was leaving the facility P1 was calling the school nonstop. A1 called P1 and P1 told A1 that S4 told P1 that C1 was not allowed back to the school. P1 mentioned that S4 was never told that P1 was not taking C1 to the doctor and said that A1 and S4 were lying.

S4 was then informed that P1 was threatening the school and S4 called the police. All of the children present at school were picked up early.

LPA received copies of the Ring Video Camera recordings. The camera is located on the left hand side of the front door. The video recording only shows the front of the building and does not show the inside of the doorway. LPA can see two parents standing at the door waiting for their children when P1 arrives to the facility. P1 walks up to the door and starts knocking. S4 opens the door and asks P1 to wait and asks the other two parents to go to the side gate to pickup their children. When the door opens again, it is unclear what S4 says but P1 says that C1 is not wearing that. P1 starts yelling, don’t push me while standing at the doorway and walking into the building. When P1 walks through the doorway, S4 appears to be standing inside the doorway. It is not clear if P1 pushes S4. P1 is not observed to be pushed out or pulled into the building by S4. As soon as P1 is inside the building, there is yelling and screaming from both adults. There is audio of what appears to sound like a physical altercation. The video does not show any children in the area of the altercation. When the officer pulls P1 out of the building P1 is carrying C1. While standing outside with the police officer, P1 tells the officer that P1 pushed S4 and S4 started socking P1. A couple minutes later, P1 is on the phone and tells someone that P1 pushed S4 and S4 socked P1.

LPA received a copy of the LAPD Investigation Report which Identifies Staff 4 as the Victim. There is a note written on the LAPD business card, that the victim does not feel safe and will get a restraining order. S4 is reporting that the restraining order is in process with the court.

After considering available information, LPA is unable to corroborate allegation, Facility staff had inappropriate interactions in front of children. The parent of C1 appears to have been the aggressor during a physical altercation with S4. S4 was informed to call the Police because P1 had made threats against the facility. S4 reacted to P1s actions out of fear that P1 had a weapon. There is no evidence that other children were present and witnessed the altercation between S4 and P1.

Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is unsubstantiated.
