On 12/22/2022 at 8:30 a.m. Licensing Program Analysts (LPAs) Deborah Lowe and Lilia Hernandez met with site supervisor Dr. Massengale. The purpose of the visit was an announce case management inspection at the facility to ensure that health, safety and personal rights as requires by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There were 7 infants present during this inspection with 3 staff. The child care center will operate Monday – Friday 6:00 a.m. – 6:00 p.m. The fire clearance was approved on 12/09/2022. Facility has a Preschool License #191870376 and a school age license #197408676.

LPAs Lowe and Hernandez toured and measured the on-limits areas and classrooms located at the facility. On March 6, 2020 the Infant room A was closed for remodeling. The remodeling has completed, this inspection is to evaluate the infant room A to be reopened. The facility has a total of 2 infant classrooms and is currently licensed with a capacity of 30 infants.

Classroom measurements are:

Indoor total measurements: Infant room A: 551.38 square (sq) feet (ft) divided by 35 sq ft = 15 infants. Facility is not requesting a capacity change. Capacity for Room A will remain at 14 infants.

Infant room B was measured during a visit conducted on 1/17/2020. On 12/22/2022 LPAs observed the room to be with no structural changes. Measurement obtained during the 1/17/2020 visit will be used for today’s visit.

Infant B 571 sq ft divided by 35 sq ft = 16 infants.

Outdoor Play measurements are:

Three outdoor play areas were measured during visit to be utilized by infants.

Outdoor total measurements: Infant playground 1 (located next to room A) and Infant playground 3 (located next to room B) total: 1,111.67 sq ft divided by 75 sq ft = 14 infants

Playground 2 located in between playground 1 and playground 3: 668.80 sq ft divided by 75 sq ft = 8 children.

Outdoor play area labeled Playground 2 is a shared outdoor area between infants and preschool. Facility currently has a waiver on file for the shared outdoor space.

Indoor/Children’s Area:

LPAs observed the indoor activity space for infants to be physically separate from space used by children in the child care center and school-age child care center components.

All outdoor and indoor passageways, stairways, inclines, ramps, open porches and other areas of potential hazard were observed to be free of obstruction. The child care center was observed be clean, safe, sanitary and in good repair. Floors in the infant rooms were observed to have a surface that is safe and clean. A comfortable temperature for children was observed. Tables and chairs were observed to be meet the needs of the children. Furniture was observed to be in good repair and safe condition.

The type, height and size of furniture and equipment was observed to be age appropriate.

Toys were observed to be safe, with no sharp points or edges or splinters, or made of small parts that can be pulled off and swallowed. Rattles were observed to be large enough so that they cannot become lodged in an infant's throat and constructed so that they will not separate into small pieces.

LPAs observed individual permanent storage space for infants clothing, personal belongings and/or bedding. All materials and surfaces accessible to children, including toys, were observed to be free of toxic substances.

LPAs advised drinking water from a noncontaminating fixture or container shall be readily available both indoors and in the outdoor activity area. Per facility the facility has a designated water filtration system to provide noncontaminated water. The facility has a pest control service to assist in keeping the center free of flies, other insects, and rodents. Trash cans were observed with tight fitting lid. No Fireplaces or open-faced heaters were observed in the infant center.

Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children were observed to be stored where inaccessible to children. LPAs advised storage areas for poisons shall be locked.

Isolation area will be located in the directors office area. LPAs advised any infant in the isolation area shall be under constant visual observation by a director, an assistant director, a teacher or an aide.

LPAs advised the isolation area shall be equipped with a crib, cot, mat or playpen for each ill infant. LPAs advised the isolation area shall not be located in the kitchen area or the general-use toilet area.

Infant A was observed with a working carbon monoxide detectors in the facility. LPAs were able to hear a successful test.

LPAs advised smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). LPAs advised a baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c).

LPAs advised there shall be at least 35 square feet of indoor activity space per child based on the total licensed capacity.

Napping:

LPAs observed 12 Cribs, cribs were observed to not limit the ability of staff to see the infant. Crib mattresses were observed to be: Covered with vinyl or similar moisture-resistant material.

Cots that meet the requirements of Section 101239.1(b) were observed be provided for all infants who have the ability to climb out of a crib. LPAs advised each crib, or cot shall be occupied by only one infant at a time. Each infant's bedding shall be used for him/her only. Facility sends sheets home weekly to be washed. Facility has a stacking washer and dryer located in Infant Room A adult bathroom to wash sheets that are soiled.

LPAs advised the calculation of indoor activity space for infants shall not include space designated and used for cribs. The sleeping area for infants was observed be physically separate from the indoor activity space.

Crib area was observed in the classroom made physically separate with the use of a gate.

Cots used for napping shall be maintained in a safe condition. Covered with vinyl or similar material that can be wiped. Wiped with a detergent/disinfectant weekly or when soiled or wet.

Each cot shall be equipped with a sheet to cover the cot or mat and, depending on the weather, a sheet and/or blanket to cover the child.

LPAs observed a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities.

Infant Changing Tables

LPAs observed changing tables to have a padded surface no less than one-inch thick and be covered with washable vinyl or plastic. Have raised sides at least three inches high. Maintained in good repair and safe condition. While in use, be placed within arm's reach of a sink. LPAs advised changing tables are not be located in the kitchen/food-preparation area.

Restrooms:

Infant rooms have adult restrooms only. Adult restrooms were observed to be inaccessible to children with the use of doors.

LPAs advised hot water temperature controls shall be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C). Notwithstanding (e) and (e)(1) above, handwashing fixtures shall not be required to deliver hot water.

Handwashing sink in Room A was observed with a hot water temperature of 118 degrees.

Adult restroom located in the office area will be used when an infant is in the isolation area located in the office area.

LPAs advised common towels or washcloths are prohibited. LPAs advised there shall be a minimum of one hand washing sink to every 15 infants and one potty chair to every five infants being toilet trained.

Outdoor:

LPAs observed the outdoor activity space to be physically separate from space used by children in the child care center and school-age child care center components with the use of gates.

LPAs observed shaded rest area for the children. LPAs observed the outdoor area to be free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard.

LPAs observed area under swings on Playground 2 to be cushioned with material that absorbs falls.

Playground was observed with no sandboxes.

The playground shall be enclosed by a fence to protect children and to keep them in the outdoor activity area. The fence was observed to be at least four feet high.

Playground 1 was observed with the water filtration equipment and pipes accessible to infants. LPAs advised per CCR 101238.2(h) any construction or equipment that could pose a hazard in the outdoor activity area shall be made inaccessible to children in care. This shall include, but not be limited to, incinerators, air- conditioning equipment, water heaters, and fuse boxes. LPAs advised water filtration equipment and pipes shall be inaccessible to infants. Facility made area inaccessible by end of visit. LPAs observed water filtration equipment and pipes to be inaccessible to infant with the use of wooden fence and plastic wall cover with lock.

No pools or other bodies of water observed.

LPAs advised there shall be at least 75 square feet per child of outdoor activity space based on the total licensed capacity.

Facility representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA reviewed with facility representative the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

An exit interview was conducted with the above items discussed and a copy of appeal rights and this report was provided to facility representative, Dr. Massengale. Final license determination will be made upon review by the Licensing Program Manager.
