Licensing Program Analyst (LPA) Seung Lee conducted an unannounced complaint inspection. Upon arrival LPA Lee met with Director Patricia Klindworth.

During the course of this investigation, LPA Lee conducted interviews, reviewed records, and made observations in regards to the above allegation.

The complaint alleges that Staff#1 yelled at Child#1 at the facility. The reporting party stated that on 01/18/2023 they witnessed Staff#1 yell and hahndle Child#1 in a rough manner through the live camera feed in Child#1's classroom. The facility denied this allegation and made no disclosure. The camera footage mentioned was not available to review per facility Director. The Director stated that the video feed of the classrooms do not have audio. During an interview, Staff#1 denied the allegation and made no disclosure.

During the course of this investigation, interviews with relevant parties did produce some evidence that supported the allegation that Staff#1 yells at children in care. Some of the examples provided during the interviews, did not directly state that Staff#1 yelled at a child or children in care, but instead stated that Staff#1 would raise their voice. While raising one’s voice is not always the equivalent to yelling, the various incidents mentioned during interviews seem to share a common context which was Staff#1 becoming frustrated with a child or children in care. While it may not be the same as yelling, raising one’s voice when addressing children in classroom while also being frustrated has the potential to violate a child’s personal rights the same way yelling at a child does. If a staff member addressed a child in care in a louder than normal manner while being frustrated, than the children being spoken to this way can feel intimidated and threatened. This is a potential risk to children in care.

Based on the evidence collected during this investigation, the preponderance of evidence has been met. Therefore, the allegation stating the facility staff yells at children in care has been substantiated. The deficiency listed on the attached LIC 9099D are being cited in accordance with California Code of Regulations Title 22.

The notice of site inspection must remain posted for a period of 30 day during hours of operation. Failure to maintain posting will result in a civil penalty of $100.00 dollars.

The Director stated that there are web cameras in the classrooms, that provide live footage of the classrooms to parents of children in care. The Director stated that she did not see the alleged interaction between Staff#1 and Child#1 due to the web cameras not storing any footage. During the course of this investigation, various interviews conducted with relevant parties did not produce any evidence that supported or went against the allegation that staff handled child in a rough manner. The reporting party stated that she witnessed Staff#1 pull a blanket away from Child#1 in an aggressive manner, and drag Child#1 by the arm across the classroom. Staff#1 stated an interview, that the only physical interaction they had with Child#1 was to help the child sit up by pulling the child up by the waist. The reporting party stated that they witnessed the Director walk into the classroom as Staff#1 was dragging Child#1 by the arm. The Director stated in an interview that when she walked into the classroom, Staff#1 and Child#1 were physically separated from each other.

Therefore, based on the evidence collected during the investigation, the allegation that staff handled child in a rough manner may be valid. However, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore at this time the above allegation is found to be unsubstantiated.

The notice of site inspection must remain posted for a period of 30 day during hours of operation. Failure to maintain posting will result in a civil penalty of $100.00 dollars.
