Licensing Program Analysts (LPAs) Mireya García and Mary Silva conducted a Case Management Deficiencies Inspection to address deficiency observed by LPA Garcia during visit conducted on February 01, 2023.

On February 01, 2023 LPA Garcia conducted a Case Management inspection to follow up with an incident reported to the Department on 11/10/22 and 01/26/2023.

During the inspection on 02/01/2023, LPA Garcia observed the carpet audio book activity that Staff #1 refused to allow child #1 to use the restroom. Upon child’s #1’s initial request to use the restroom Staff #1 stated to child #1 “you already went already”. LPA Garcia then approached Staff #1 and asked Staff #1 who wanted to go to the restroom. Staff #1 pointed at child #1. LPA then asked Staff #1, why child #1 was not allowed to use the restroom and Staff #1 repeated, “she already went”. LPA Garcia discuss age and needs of children in care and advised Staff #1 to let child #1 use the restroom. Staff #1 then told child #1 to go use the restroom. LPA observed child #1 entered the restroom where Staff #2 was providing restroom supervision. LPA Garcia informed Staff #2 of LPA’s observation of Staff #1 not allowing child #1 to use the restroom and then Staff #2 responded, “that’s what happens when they send us staff that are not qualified”. LPA discuss personal rights of children in care with Staff #1 and Staff #2.

Based on LPA’s observation it was determined that the personal rights of Child #1 were violated by Staff #1. This poses a potential health and safety risk to children in care. Title 22 Regulation Section 101223 Personal Rights states (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.

A notice of site visit was given and must remain posted for 30 days.

Per Supervisor, Staff #1 has been blocked from site. On 02/03/23, staff #1's assignment was canceled and will no longer be accepted when requested by sub services with Child Care Careers. Cancellation request an order was provided in writing to LPAs during visit.

Based on LPA Garcia's observation on 02/01/2023 it was determined that the personal rights of Child #1 were violated by Staff #1. This poses an immediate health and safety risk to children in care.

Supervisor will provide training to all staff in regard to personal rights and will demonstrate CCLD personal rights video (https://ccld.childcarevideos.org/child-care-center-operators/childrens-personal-rights-in-child-care/) to ensure staff follow Title 22 Regulations. Supervisor will then submit the training agenda, materials and staff sign in attendance for the training to CCLD by or before 04/07/23 in order to clear this citation.
