Licensing Program Analyst (LPA)Katrina Chicote conducted an Unannounced Required – 1 Year inspection to the above facility on 12/22/2021 at 8:45 AM. LPA attempted to conduct COVID-19 screening call prior to entering facility, Licensee did not answer telephone and no voicemail was available. Upon arrival, LPA disclosed the purpose of the inspection and met with Licensee, Miriam Morales, who guided the LPA on a tour of the facility. Adults residing in the home were discussed and all have criminal record clearance. There were four day care children present during today’s inspection. Licensee states that there are currently four children enrolled. The children's roster was reviewed and is current. Per licensee, the facility’s hours of operation are 7:00 AM to 5:30 PM Monday thru Friday. Emergency Disaster Plan, License, and Parents’ Rights were posted at the time of inspection. Disaster drill log was also available during today’s inspection, last disaster drill conducted on October 2021.

This is a two-story home which consists of three bedrooms and two and a half bathrooms, den, living room, kitchen/dining room, and attached garage. Areas used by the children include the living room (located to the right upon entry) used for receiving children and sick/isolation area, kitchen/dining room (located next to living room) used for eating, half bathroom (located down hallway to the right of the home), and den (located down hallway to the left of home) as main daycare space. Per Licensee, areas off limits to children and parents include attached garage and entire upstairs, which contains all three bedrooms and two full bathrooms. At 8:53 AM, LPA observed that there is am operable baby gate blocking access to stairs and making upstairs off-limits. Per Licensee, off limit garage is locked during operating hours, LPA observed doors to be locked.

All areas identified on the facility sketch as accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for the safety of the children. LPA observed central air/heat through out home. There is a working telephone maintained in the home. At 9:05 AM, LPA observed main daycare space to have circle time area with books, calendar posted, blocks, puzzles, art materials, and other age appropriate toys, free of loose and sharp parts available for children in care. LPA observed electrical cover outlets all through the home. At 9:07 AM, LPA observed half bathroom that children will use to have operable toilet and sink, adequate hand washing supplies, floor free of hazards, and observed all cabinets and drawers to be free of hazards at time of inspection. At 9:10 AM, LPA observed Dining Room/Kitchen area to have large dining table with six chairs and two high chairs used for infant eating. Detergents, cleaning compounds, medications, and other items which can pose a danger to children are inaccessible. The Licensee states that there are no poisons in the home. The Licensee does understand that poison must be locked with a key or combination lock. At 9:11 AM, LPA observed detergents and cleaning compounds to be kept in high shelf in kitchen and knives kept in a drawer with operable child safety lock making these items inaccessible to children in care. Per Licensee any medicines is kept in off limits upstairs bedroom/bathroom. At 9:12 AM, LPA observed Living Room to have a flat screen TV, couch, child size chair, and Graco pack-n-play used for infant sleep. LPA observed standard blue mats in storage closet that Licensee states she uses for older kids napping. Per Licensee, she has a small dog that is kept in upstairs off limits area during operating hours.

Per Licensee, the children will have access to front yard for outdoor play. At 9:14 AM, LPA observed front yard has turf grass, adequate perimeter fencing through-out, plastic play houses, plastic ride along toys, basketball court and other age appropriate toys free of loose and sharp parts available for children in care at time of inspection. LPA observed all trees, shrubs, and plants are maintained at time of inspection.

Per Licensee, there are no weapons, firearms in the home and there are no bodies of water around the premises. LPA observation did not see any of these around the premises at time of inspection. Per licensee, they provide food for children in care.

At 9:06 AM, LPA observed the valve on the required 2A 10BC fire extinguisher indicates fully charged with service tag. At 9:08 AM, LPA observed smoke and carbon monoxide detectors are in operable condition at time of inspection. Per Licensee, First Aid kit is kept in the main day care space, LPA observed First Aid kit and was inventoried for necessary supplies. The Licensee has current Pediatric First Aid and CPR. Proof of immunization against influenza, pertussis, and measles was readily available during today’s inspection. The Licensee has also taken the Mandated Reporter Training

—Children records and required licensing forms were discussed as well as mandated child abuse reporting and criminal record clearance requirement.

The following were discussed:
Incidental Medical Services (IMS)
Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee (or facility representative) was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The Licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care.

LPA discussed the safe sleep regulations with licensee [or facility representative] and discussed the Child Care Licensing Safe Sleep webpage athttps://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Senate Bill 792: this bill, commencing September 1, 2016, prohibits a person from being employed or volunteering at a child care facility or family day care if he or she has not been immunized against influenza, pertussis and measles. LPA discussed the influenza waiver during the visit.


The facility was found in compliance per Title 22 regulations, there will be no deficiencies cited today 12/22/2021.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
