On 07/27/23 at 2:08PM, Licensing Program Analyst (LPA) Laticia Thompson conducted an unannounced site visit for the purpose of delivering findings for complaint allegations received on 05/10/23, associated to complaint control number 58-CC-20230510092450. LPA met with Sharon Johns, Director and explained the purpose of the visit. During today’s visit, there were 5 staff providing care and supervision to 26 children in care.

LPA Laticia Thompson is delivering complaint findings for complaint investigations conducted by LPA Antonio Almanza. During the course of the investigation, LPA Almanza conducted interviews with six staff; LPA Loyce Phillips conducted interviews with five parents on 06/30/23; in addition,

LPA Almanza made observations regarding the aforementioned allegations. Pertaining to the allegation that “Daycare children had access to medication/pills”.

LPA Almanza interviewed five staff regarding the allegation that daycare children had access to medication/pills. Staff 3, 4, and 5 disclosed that they have no knowledge of medications/pills in the classrooms. Staff 2 disclosed that a teacher found a Ziploc bag with one or two pills in their classroom and gave it to Staff 6. Staff 6 disclosed that a teacher gave her a small bag, with what appeared to be an herbal pill, and said someone planted it in their classroom. S6 did not keep or take a picture of the pill. S6 disclosed they thought the pill appeared to be a vitamin.

LPA Almanza was unable to interview the reporting party or the teacher who found the medication/pill in the classroom. LPA Almanza is unable to determine exactly what the medication/pill was, where in the classroom the medication/pill was found, whether there were children in the classroom when the medication/pill was found and/or whether the Ziploc bag was accessible to children in care.

The department has investigated the allegation that “Daycare children had access to medication/pills” and it was revealed that one or two pills in a Ziploc bag was given to S6, but it could not be determined what it was, where it was found, and whether it was accessible to children in care.

This agency has investigated the allegation that ““Daycare children had access to medication/pills” and that there was a violation of Title 22, Division 12, Chapter 1, Article 06, Section 101226 Health-Related Services. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.

No deficiencies are being cited for the allegation listed above.
