On 07/27/23 Licensing Program Analyst (LPA) Laticia Thompson conducted a subsequent unannounced site visit for the purpose of delivering findings for complaint allegations received on 05/10/23, associated to complaint control number 58-CC-20230510092450. LPA met with Director, Sharon Johns and explained the purpose of the visit.

LPA Laticia Thompson is delivering complaint findings for complaint investigations conducted by LPA Antonio Almanza. During the course of the investigation, LPA Almanza conducted interviews with six staff; LPA Loyce Phillips had conducted interviews with five parents on 06/30/23; in addition, LPA Almanza made observations regarding the aforementioned allegations. -- Page 1 of 2

Pertaining to the allegation that the “Classroom (is) operating out of ratio”:
All staff interviewed denied being out of ratio. Staff all correctly stated that the pre-school ratio is twelve children to one staff. Staff 3 disclosed that there are eleven children enrolled in their class, they have an average of five children attend each day, and that they have a teacher’s aide. Staff 4 disclosed that has never seen more than twelve children per teacher or more than 15 children with two teachers. Staff 5 stated that the largest classroom has 17 children, but that there are always two staff; otherwise, they have not heard about a teacher having more than twelve children by themselves.

Staff 2 disclosed that there are 21 children enrolled in their class but that there are always two teachers present. Staff 6 disclosed that they make sure they have the staff needed to stay within ratio; that they have staff that are multifunctional that can be placed in classrooms when needed; and that the classroom with 17 children always has two staff.

On 06/30/23, LPA Phillips interviewed five parents and ratios were discussed. Parent 1 disclosed that on one occasion, they had 20 children in a classroom with one staff member. Parent 3 disclosed that has seen nine children with one teacher. Parent 5 disclosed that the parent went into the facility and there were about 10 children in the classroom.

On 04/19/23, LPA Phillips observed four staff providing care and supervision to 40 napping preschool children. On 05/17/23, LPA Almanza conducted a site visit and observed four adults providing care and supervision to 15 preschool children. On 07/10/23, LPA Phillips conducted a site visit and observed four staff providing care and supervision to 24 preschool children. During the three site visits, the facility was within ratio.

As no staff and one parent interviewed stated that the Center operates out of ratio, and the Center was within ratio during three separate unannounced site visits, the allegation that the classroom is operating out of ratio has been determined to be Unsubstantiated.

This agency has investigated the complaint alleging that “Classroom operating out of ratio” and that there was a violation of Title 22, Division 12, Chapter 1, Article 06, Section 101216.3 Teacher-Child Ratio. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.

No deficiencies are being cited for the allegation listed above.

A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the facility representative Sharon Johns.
