On August 17, 2023, Licensing Program Analyst (LPA) Monique Ayala conducted an unannounced case management inspection at the above facility. The purpose of the inspection is to follow up on three incidents that were reported timely to the department. One incident occurred on 05/23/2023, the second incident occurred on 06/02/2023 and the last incident occurred on 06/26/2023. A COVID-19 risk assessment was conducted prior to entering the facility. LPA met with Principal Jessica Robeles-Logan who guided LPA on a tour of the facility. LPA observed 49 children in care with 14 staff.
Brief summary of incident #1: On 05/23/2023, Child #1 (C1) informed Parent #1 (P1) that Staff #1 (S1) grabbed C1's arm. Per P1 there were no marks on C1's arm. C1 stated that he was yelling at Child #2 (C2) and that is why S1 grabbed him.

Brief summary of incident #2: On 06/02/2023 at approximately 2pm, Staff #2 (S2) was sweeping the green room and found a vitamin on the floor, vitamin was picked up. Staff #3 (S3) noticed C2 holding something in her hand and questioned C2. C2 was holding another vitamin. C2 stated she got the vitamin from her cubby.

Brief summary of incident #3: On 06/26/2023, at approximately 3:40pm, Child #3 (C3) was on the apparatus. C3 lost her footing and hurt herself between the legs on the apparatus bar near the stair case. S1 provided first aid to C3. Parent #2 (P2) took C3 to seek medical attention. C3 obtained a laceration from the incident and returned to school on 06/28/2023.

During the inspection LPA interviewed C1, S1-S4, obtained a copy of staff written statements, a copy of the facility roster, obtained pictures of apparatus and other relevant documents.

Incident #1: LPA interviewed C1 who did not disclose that S1 grabbed him. C1 stated that he liked S1 and likes to eat with S1. LPA interviewed S1 who stated that she has never violated a child's personal rights and has never observed a staff member violate a child's personal rights. S1 stated that C1 and her have a close relationship and C1 always comes to her to eat and play.

Incident #2: LPA interviewed S2 who stated that she is the EEC Attendant who assist the facility with ensuring the facility is clean and safe. S2 stated that she was sweeping the classroom and observed the vitamin on the floor near the children's cubbies. S2 stated there were no children present during that time. S3 stated that she observed C2 with something in her hand while lining up to go outside to play. S3 asked C2 what she had in her hand and C2 opened her hand exposing another vitamin. S3 asked C2 where she got the vitamin from and C2 stated "shopping". S3 asked C2 where in the classroom she got it from and C2 pointed to her cubby. S3 stated she took the vitamin and disposed of it. S3 stated that the staff conducted a thorough cleaning of the classroom to ensure there were no more vitamins. Per S3 facility staff talked to C2 father about the incident. LPA was unable to interview C2 as C2 no longer attends the facility. LPA will call C2's parents/guardians to conduct an interview.

Incident #3: LPA interviewed S1 and S4 who stated that C3 was standing on the stairs of the apparatus. S4 stated that she had told C3 not to place her foot on the bar to make sure she didn't hurt herself. S4 stated that she was standing right next to the stairs and had turned around to assist another child. S1 stated that she observed C3 slip and hurt her private area on the bar. S1 and S4 stated that S1 took C3 to the restroom to provide first aid. C3 sustained a laceration from the incident. Per S1 and S4 there was enough supervision during the time of the incident. LPA was unable to interview C3 as C3 no longer attends the facility. LPA will call C2's parents/guardians to conduct an interview.

There are no deficiencies being given at this time as the incidents still require further investigation.

An exit interview was conducted and a copy of this report was provided to Principal, Jessica Robles-Logan along with Notice of Site Visit and Appeal Rights.
