Licensing Program Analyst (LPA) Mireya García conducted an unannounced Case Management inspection due to an incidents that were reported to the Department on March 10, 2023 & March 29, 2023. LPA met with Principal, Desiree Hall who guided LPA on a tour of the facility. Census was taken.

The purpose of this report is to address the investigative findings of the unusual incident reports that were reported to the Department.

On March 10, 2023, an incident was self reported to the Department via telephone by the facility who reported a parent alleges that back in December of 2022 child's personal rights were violated while in care.

During the inspection conducted on June 09, 2023, LPA Garcia conducted interviews with Principal, two (2) staff and two (2) day care children.

During the course of the investigation, LPA obtained a copy of the LIC 9040 Children's roster dated 06/09/23, Classrooms #1A & #3 sign in/out sheets for the week of 03/06-03/10/23, Ouch report dated 03/09/23, Cautions regarding head injury report for Child #1 dated 03/09/23, picture of child #1's injury, two (2) Staff signed written statements dated 03/14/23, 03/27/2023 & 03/28/2023, and conducted interviews with seven (7) staff, five (5) day care children and attempt to interview child #1 & Parent #1. All interviews conducted with Staff deny observing any male staff or any staff hit any child in care. No disclosures were made by all five (5) children interviewed. LPA attempted to interview Child #1 however, child is no longer enrolled at the facility and parent of child #1 refuse interview. Based on the interviews conducted, at this time there is not enough evidence to support that child #1’s personal rights were violated while in care.

This agency has investigated the incident that alleges that a child #1's personal rights were violated while in care. Although the allegation may have happened or is valid; Based on interviews conducted with seven (7) day care staff and five (5) day care children it was determined there were no witnesses to any children being hit while in care. Parent of child #1 refused to allow interview of child #1, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore at this time the allegation is deemed Unsubstantiated. Should additional information become available in the future, this investigation may be reopened.

In addition, LPA Garcia follow up on the incident that was self reported on March 29, 2023, to the Department via telephone by the facility who reported a parent disclose to staff that their child patted their private area and when child was asked where did they learn this from child disclosed from a student at school.

During the course of the investigation, LPA Garcia interview four (4) staff, child in question, two (2) other day care children and several attempts were made to interview parent of child in questioned via telephone. Interviews conducted with all four (4) staff deny having any knowledge and/or observing any inappropriate behavior from child in question and/or any other children in care. Child in questioned and two (2) other children interviewed made no disclosures. Based on the interviews conducted, at this time there is not enough evidence to support that child’s personal rights were violated while in care.

This agency has investigated the incident that alleges that a child’s personal rights were violated while in care. Although the allegation may have happened or is valid; Based on interviews conducted; there were no disclosures from child in question, staff, children and there is no witness to the allegation, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore at this time the allegation is deemed Unsubstantiated. Should additional information become available in the future, this investigation may be reopened.

A notice of site visit was given and must remain posted for 30 days.
