Licensing Program Analyst (LPA) Rita Ramos conducted an unannounced complaint inspection to the above facility. LPA met with Claudia Jones, Teacher, who guided analyst on a tour of the facility. There were 78 children with 14 staff upon arrival.

During the investigation LPA conducted interviews with staff, obtained a copy of the facility roster and parent handbook. LPA also obtained copies of supporting documentation.

Information provided by the reporting party indicates that video recordings of Child #1 was taken by the facility staff without parental permission. Per Reporting Party, permission was not granted to the facility to take video of Child #1 in the manner that child was recorded.

Per Principal, the facility has signed parental permission to photograph Child #1 and Parent #1 gave verbal permission to photograph child in the manner that they were photographed. -----Page 1 of 2

When interviewing staff, Staff #1 and Staff #2 disclosed that Parent #1 gave the facility staff verbal permission to photograph Child #1.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Exit interview was conducted with Claudia Jones, including, but not limited to Provider Rights, Appeal Procedures and Agencies Consultative Role.
