On 07/12/23 at 7:55 AM, Licensing Program Analyst (LPA) Silva Garibyan arrived at Fair Avenue Early Education Center to deliver the findings of a complaint received by the Department on 05/08/23 associated to Complaint Control Number 58-CC-20230508124408. LPA met with Principal Lessly Mora and explained the purpose of the visit. During today’s visit, there were 9 staff providing care to 45 preschool children.

During the investigation into the allegation that “Staff are not adequately supervising day care children while in care,” LPA obtained copies of the facility roster and conducted interviews with five staff, nine parents and five children.

Information provided by STAFF 1, STAFF 4, CHILD 1, AND CHILD 3 indicates that CHILD 1 and CHILD 3 were in the bathroom at the same time, and the teacher was standing at the door. When the children were washing their hands and were about to leave the bathroom, CHILD 1 walked past CHILD 3 and touched CHILD 3‘s private area. CHILD 1 then quickly walked away. The children both had clothes on. The teacher was looking outside at the line when this happened.

In another incident, information provided by STAFF 3, CHILD 1, and CHILD 2 indicates that CHILD 1 AND CHILD 2, while working with child safe scissors on a project and sitting right in front of the teacher, turned their backs to the teacher and each cut a piece from their hair.

Based on interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, is being cited on the attached LIC9099D.

Each report documenting a Type A citation shall remain posted for 30 days along with the Notice of Site Visit. In addition, a copy of this report must be provided to the authorized representatives of all currently enrolled children and any newly enrolled child for the following 12 months. The ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS (LIC9224) shall be signed and kept in each of the children’s files. The report shall be provided no later than the next business day or the next day the child is in care.

A notice of site visit was given and must remain posted for 30 days.

Responsibility for Providing Care and Supervision: The licensee shall provide care and supervision as necessary to meet the children's needs. No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.

This requirement is not met as evidenced by: Child 3 was touched inappropriately by Child 1 while in the bathroom; and while working on a project, Child 1 and Child 2 turned their backs to the teacher and cut a piece from their hair.This poses an immediate health, safety or personal rights risk to the children in care.

Per reporting party, Staff 5 yells and curses at their child. LPA interviewed five children, and none stated that the day-care staff yells at them. LPA interviewed parents who explained that their children have never complained about any teachers not being nice to them.

The second allegation provided by the reporting party indicates that “Staff use inappropriate language with day care child while in care.”


LPA interviewed seven parents, five children, and five staff and none stated that the day-care staff use inappropriate language. Per reporting party, Child 1 told their parent that the teacher says the “B”-word. During the interview, Child 1 told LPA that the teacher said, "What the heck?"

The third allegation provided by the reporting party indicates that “Staff did not safeguard day care child's personal belongings.”

Per reporting party, they sent a new water cup with their child to school. During pick up, the cup was not with the child, and no one could locate it. Per STAFF 1, STAFF 2, and STAFF 3, CHILD1’s water cup was found in the trash and child informed reporting party that their friend threw it in the trash. No disclosures were made by any of the children or parents interviewed.

The fourth allegation provided by the reporting party indicates that “Staff handle day care child in a rough manner while in care.”

Per reporting party, STAFF 5 purposely tripped Child 1. Child 1 disclosed that reporting party says that the teachers don’t like them because they are Black. Per STAFF 1, CHILD 1 is very aggressive when they run. There have been instances where CHILD 1 is running around so fast and aggressively, that they run over other students or teachers and then turns around and says that they tripped CHILD 1. No disclosures were made by any of the five children and seven parents regarding staff handling day care child in a rough manner while in care.

Based upon the evidence as presented above, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
