32 | Principal stated that supervision is provided, and child was within staff visual and audio supervision. The Principal also disclosed that the incident that occurred on 5/31/2023 was also reported to the licensing department regarding a child falling from a slide which resulted in a fracture to the arm. The fall was reported to the parent immediately and the parent picked up child after being notified. Principal stated that the child who sustained an injury to their arm, returned to school and an agreement was made with the parent to make accommodations for the child while under a physician’s care.
While interviewing staff, Staff #2 disclosed that the child was observed going down the slide and midway down the slide, child stood up to climb back up the slide in which staff #2 observed child fall and land on there right side of their body. Staff disclosed that the incident took place during transition from the outdoors to indoors. Time frames were consistent between staff in which the incident occurred between 9:55AM and 10:00AM. Staff also disclosed that child was provided with first aid and kept stable until parent arrived to pick up child. Staff disclosed that while the child was under physician’s care, the child was to relocate to a different classroom for indoor activities while their class went outdoors to play.
While interviewing parents, Parent #6 made no disclosures regarding the center not providing a safe and comfortable environment and disclosed they are satisfied with the operation of the facility. Documents obtained from the facility show the child was picked up at 10:08AM, signed out by parent and that the child was not to participate in physician education classes.
Based on the investigation conducted by LPA Hernandez, it has been determined that although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
The Notice of Site Visit must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Principal / Lessly Mora, including, but not limited to Provider Rights, Appeal Procedures and Agencies Consultative Role. |
