32 | During the interview with the Principal, Principal disclosed that Parent #1 met with Principal regarding Child #1 being pinched on the neck. Parent #1 disclosed to Principal the concerns with Child #1’s personal rights being violated. Principal disclosed that prior to interviewing Parent #1 and Child #1, Parent #1 had already addressed the incident with Staff #3. Principal disclosed that prior to LPA Hernandez conducting the investigation, per LAUSD policy, interviews were conducted with staff and children.
Principal stated that no disclosures were made to support the allegation.
During an interview with Staff #3, Staff #3 denied pinching any child while in care. Staff #3 stated that children at no time are physically redirected. Children are redirected using visual cues. Visual cues are flash cards with pictures for children to see what the classroom rules and expectations are.
During an interview with Staff #4, Staff #4 disclosed concerns with Staff #3 violating the personal rights of Child #1. Per Staff #4, Parent #1 disclosed to Staff #4 that Child #1 was pinched on the neck. Staff #4 also disclosed that Child #1 approached Staff #4 and identified Staff #3 as the individual that pinched Child #1 on the neck.
During an interview with Child #1, Child #1 disclosed that during lunch time, they stood up to attempt to throw their trash away outdoors. Child #1 stated that Staff #3 pinched Child#1 on the neck to stop them from exiting the classroom. When LPAs asked Child #1 how that made them feel, Child #1 responded sad because Staff#3 did not apologize for pinching their neck.
Based on the investigation conducted by the Department which includes interviews, record reviews, and other pertinent information, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 101223(a)(3) Personal Rights is being cited on the attached LIC9099D.
A notice of site visit was given to the licensee and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
A copy of this report and appeal rights was provided.
