Licensing Program Manager (LPM) Rita Ramos and Licensing Program Analyst (LPA) Joe Katrdzhyan conducted an unannounced case management inspection on 09/15/23. LPM and LPA arrived at the facility at 10:20am and met with Armando Inclan, Principal, who guided LPM and LPA on a tour of the facility. There were 28 children with 11 staff present upon arrival.

The purpose of the visit is to follow-up on a previous visit LPA Lilia Hernandez conducted at the facility on 07/21/23 in which it was discovered that the facility was under construction. During the 07/21/23 visit, LPA Hernandez also discovered that parts of the outdoor playground were closed off which reduced the outdoor space available for children and resulted in emergency exits being blocked off with chain link fencing. In addition, LPA Hernandez observed that Room 3 and one of the children’s restrooms had a water break and repairs were pending.

As LPA Hernandez conducted follow-up correspondence with Principal Inclan regarding the construction, the principal disclosed plans for asbestos abatement to commence on 09/18/23. Per Principal, the plans are for 2 weeks commencing 09/18/23 in which children will be required to be in care outdoors from 4:00PM to 5:30PM and no one may enter or be in the actual building after 4:00PM. Per Principal, if weather is not permitting, asbestos abatement work indoors will not start until after students and staff leave the building for the day and a large portable restroom will be used during these 2 weeks and

students will have all personal belongings outside in order not to reenter the building during the abatement work. LPM and LPA Katrdzhyan were informed that only one portable restroom will be available for staff and children to use.

During today’s visit LPM and LPA Katrdzhyan observed that there are currently only 7 toilets and 8 sinks available for children’s use indoors. LPM and LPA Katrdzhyan informed the principal that based on the total licensed capacity, one toilet and one handwashing fixture shall be maintained for every 15 children as noted under the Title 22 regulation 101239(h). LPM and LPA Katrdzhyan also advised Principal that they will also be out of compliance under the Title 22 regulation 101239(i) if they decide to go through the asbestos abatement plan with only one portable restroom since they are required to have a separate restroom for staff that is not used for children. The 101239(i) regulation further notes that the toilet used by staff shall be conveniently located in relation to the isolation area and the principal does not have a plan for an isolation when the asbestos abatement commences. No plan for an isolation area can lead to out of compliance under Title 22 regulation 101226.2 noting that there shall be an isolation area for children that may become ill while in care. Per Principal, the facility currently has low enrollment and only 14 children will be in care from 4PM to 5:30PM. LPM and LPA Katrdzhyan again, informed the principal that the regulatory requirement shall be met on the total licensed capacity and not the number of enrollments.

During this inspection the principal was not able to provide LPM and LPA information noting that it is safe for children to return and enter the facility from Monday through Friday after asbestos abatement. Per Principal, they will research the information and

provide it to the department by 09/18/23 and Principal will ensure the asbestos Abatement will begin after 5:30pm, to ensure that no children will be present. LPM and LPA inspected the outdoor area and observed the construction. There is a temporary chain link fence that closes off more than half of the outdoor yard. LPM and LPA Katrdzhyan also observed one portable restroom on the outdoor yard which further reduces the available outdoor space for children in care. Per Principal Inclan, they were under the impression that the facility was licensed for 70 and showed LPM and LPA Katrdzhyan a copy of the licensed referenced. LPM and LPA Katrdzhyan observed that the license comments indicates a capacity of 117 however also mentions a school-age program which the facility does not have. LPM and LPA Katrdzhyan advised principal to submit an application to reduce the capacity and to correct the ages of children being cared for which per principal, should be exclusive to preschool children.

While touring the facility, LPM and LPA Katrdzhyan observed that Room 1 and Room 2 continue to have areas boarded off which reduces the indoor space. The report dated 07/21/23 notes that this construction of the indoor classrooms should have been completed by 08/14/23. CCL did not receive any reports regarding the construction not being completed in rooms 1 and 2. Furthermore, LPM and LPA Katrdzhyan were informed during today's visit that the construction for the outdoor area will continue for another year and half.

LPM and LPA Katrdzhyan advised Principal to submit a waiver request and plan detailing how the facility can maintain compliance and that enrollment cannot exceed 70 as noted on the licensed posted at the facility until repairs, asbestos abatement, and construction is completed.

concerns and regulations noted on this report regarding fixtures, furniture, and equipment which includes 101214 Accountability which notes that the licensee is accountable for the establishment of policies concerning its operation.

CCL will continue to conduct follow up visits to ensure the health and safety of children are being met.

The following deficiency listed on the attached deficiency page is being cited in accordance with California Code of Regulations Title 22.

Reporting Requirements. The licensee shall notify the Department in writing of his/her intent prior to making any structural changes that reduce the total amount of indoor or outdoor activity space. Such structural changes shall include, but not be limited to, room additions.
