Licensing Program Analyst (LPA) Mireya García arrived unannounced at the facility for the purpose of conducting a follow up complaint investigation to deliver findings regarding the allegations listed above. Due to COVID- 19 precautionary measures were taken, licensing staff present during inspection wore appropriate personal protective equipment. LPA met with Office Manager, Marfa Garcia, who guided LPA on a tour of the facility. Principal, Barbara Page was not present during the tour but later arrived. There were twenty (20) children observed to be present at the facility during this inspection.

Information provided by the complainant alleges that staff hit child in care and parent wasn't let into facility.

During this investigation, interviews were conducted with staff, children, and parents on 03/17/2022, 05/02/2022, 05/03/2022 and 05/04/2022. Declarations from staff and children’s rosters dated 03/17/2022 and 05/02/2022 were obtained during this investigation on 03/17/2022 and 05/04/2022.

Pertaining to the allegation that staff hit a child in care, during interviews conducted with approximately (6) staff and (8) day care children, a staff witness, Child #7, and Child #9 confirmed information regarding Staff #1 violating a child’s personal rights on two separate occasions.

This poses an immediate health and safety risk to children in care. Title 22 Regulation Section 101223 Personal Rights states (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.

Regarding to the allegation of parent wasn’t let into facility, interview with the Principal reveal that parent was denied entry into the facility as a COVID 19 safety precautionary measure at this time parents are not entering facility. Interviews with ten (10) day care parents confirm that parents are denied entry and are not allowed to enter the facility due to COVID.

Based on LPAs interviews which were conducted, and record reviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiencies are being cited (see attached 9099D).

A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). Acknowledgement of Receipt (LIC 9224 form) must be maintained in each child’s file immediately upon receipt from parent. Office Manager, Marfa Garcia was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form (English/Spanish/Chinese).

A notice of site visit was given and must remain posted for 30 days.

Per Principal, she has provide training to all staff in regards to personal rights and demonstrated CCLD personal rights video (https://ccld.childcarevideos.org/child-care-center-operators/childrens-personal-rights-in-child-care/) to ensure that staff is following Title 22 Regulations.

Based on LPA’s interviews conducted disclosures confirmed by staff that incident took place where parent asked to come inside facility and Principal denied parent entry. Interviews with ten day care parents confirm that parents are denied entry and are not allowed to enter the facility due to COVID. This poses a potential health and safety risk to children in care.
