32 | During interviews conducted with staff and day care children disclosures were made regarding a Personal Rights violation conducted by Staff #1. Staff #1, two (2) witnesses and more than one (1) child confirmed this information. This poses an immediate health and safety risk to children in care. Title 22 Regulation Section 101223 Personal Rights states (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.
The following deficiency is being cited in accordance to Title 22 of the California Code of Regulations. Please refer to LIC809D for documentation of deficiency cited.
A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). Acknowledgement of Receipt (LIC 9224 form) must be maintained in each child’s file immediately upon receipt from parent. Principal, Josefina Navarro was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form (English/Spanish).
A notice of site visit was given and must remain posted for 30 days.
