On 05/17/2024 at 12:30 PM Licensing Program Analysts (LPAs) Claudia Kam and Katrina Chicote conducted an Unannounced Complaint Inspection for the purpose of initiating the 10 day investigation to the above allegations. Upon arrival, LPAs announced purpose of inspection and met with Licensee, Olga Mera, who granted entry to facility. LPA Kam conducted inspection and interviews in Spanish.

LPAs observed Licensee with three preschoolers playing outside upon arrival. LPAs observed an infant being carried inside by Assistant (A1), total census four children present during today's inspection.

During this inspection, LPAs were provided guided tour of facility both indoors and outdoors, including off limits areas. LPAs observed "Rat & Mouse Glue Traps" on Kitchen counter. Per Licensee, she did have a pest issue that she is currently addressing. Licensee showed LPAs a hole that was patched up that Licensee states was chewed by pests. Licensee admits that individuals not cleared: Humberto Suarez resides in Bedroom 5 and Maria Minerva Suarez resides in detached ADU.

Based on the available information, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. In this case there is concrete evidence to state that the above allegations occurred at the facility and is substantiated.

The following citations are being cited today on the attached LIC 9099D.

LPAs informed Licensee Olga Mera that this report dated 05/17/2024 document one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPAs informed the Licensee to provide a copy of this licensing report dated 05/17/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A violation regarding criminal record clearance (2) warrants an immediate civil penalty of $500 max/person and is hereby assessed, see LIC 421IM.

A notice of site visit was given and must remain posted for 30 days.

Exit interview was conducted and report was reviewed with the Licensee, Olga Mera.

Licensee states that she has evicted these individuals and are scheduled to leave on 06/01/2024. Licensee states individuals refuse to leave until this date. Licensee states she will provide update to LPA Kam on 05/20/2024 as they are scheduled to sign documents in regards to evicton.

Based on LPAs record review and interview, Licensee did not have two individuals living in the home cleared. This poses an immediate health, safety, and personal rights risk to children in care.

Declaration obtained from Licensee in regards to supervision plan and ensuring individuals do not enter childcare area. Licensee states the backdoor will remain locked while children are in care. LPA observed there is a lock on backdoor.

Licensee states she has not seen pests for five months as she has created a plan that involves traps, filling in hole where pests were getting access to home, and cleaning daily with ammonia. LPAs observation confirm Licensee's statement. Clearing deficiency on this date.
