----------------------------------------------------This is an ammended report------------------------------------------------------An unannounced inspection was conducted by Licensing Program Analysts (LPAs) Roxana Lopez and Saul Valenzuela on 03/28/2024. A COVID risk assessment was conducted. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 02/08/2024. LPA met with Licensee, Rocio Hernandez to whom the purpose of the inspection was announced. Census was taken.

Throughout the course of the investigation, interviews were conducted with staff, children and parents. LPA also reviewed and obtained copy of children’s roster.

Per initial complaint report, the Reporting Party (RP) reported that they were informed that Licensee hits Child # 1 on the buttocks and yells at Child # 1 during naptime, because they won’t stop crying. Per RP they do not have dates of incident and has not observed any injuries. Child # 1 was not available for interview as they are non verbal.----- pg.1 of 2 -----

In regards to allegation # 1 licensee hit day care child and allegation # 2 licensee yelled at children in care: LPA conducted interviews with staff # 1 and staff # 2. All staff statements corroborated that they have not hit a child or yelled at a child during nap time and have not witnessed any staff hurting or yelling at a child. Staff # 1-2 corroborated that if children are having a hard time during nap they rock them, pat them and make sure that all of their needs are met. If children continue to cry they are taken outdoors to play.

LPA conducted interviews with children. Children’s statements corroborate that they like the staff in the facility and that they have not been hurt or yelled at by any staff, or have not observed any other child in care to be hit or yelled at by staff. Additionally, children corroborated that when a child does not want to sleep they are taken outside- babies are rocked and if they don’t sleep they will go outside.

LPA conducted interviews with parents. Parent’s statements corroborate that they do not have any concerns with staff and that they are happy with the care their child receives.

This agency has investigated the complaint alleging Licensee hit day care child and licensee yells at children. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

A notice of site visit was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with Licensee Rocio Hernandez.
