On November 28, 2023, at 9:00 AM, Licensing Program Analysts (LPAs) Angelica Wallin and Alicia Mooberry, conducted an unannounced Annual Required Inspection for the preschool license. During today’s inspection, LPA met with administrator, Jerry Hale, and toured the facility indoors and outdoors. Days and hours of operation are Monday through Friday from 7:00 AM - 6:00 PM. This facility consists of 1 large classroom, a small children’s lounge (used as an isolation room) and an outdoor play area.

All areas identified on the Facility Sketch were inspected. Upon arrival, the following no staff were present during this inspection. Administrator informed LPAs that facility is in process of hiring more staff and obtaining children. Per administrator, no children enrolled at this time. Capacity and limitations as specified on the license are being maintained. The following was observed during the tour of the facility:

Furniture and equipment were inspected for age appropriateness and good repair. During inspecgtion, LPAs observed paint chipping off storage closet located in classroom and wall heater barricades located in large classroom and children’s lounge not anchored to the wall. A type B citation issued.

Telephone service, heating, lighting, and ventilation were evaluated. Children have their own cubby to store their belongings. LPAs observed napping cots are stored in teacher’s lounge. Age appropriate sinks and toilets were inspected for availability and good repair in all classrooms. During inspection, LPAs observed children's bathroom with toilets containing grime and broken floor tiles. A type B citation issued.

Per administrator, drinking water is used via water dispenser for classroom and outdoor play. Per PIN 21-21-CCP lead testing to be conducted for all equipment used for drinking consumption. Per administrator, no water fountains used for consumption of water.

Per LPM A. Chico, all water needs to be lead tested if used for food preparation and washing. Per administrator, no food service is provided at this time. Per administrator, children In care will bring their own food. No water used for food preparation or washing. Director to provide LIC 855 written declaration statement regarding use of water in facility.

During inspection, LPAs observed bleach and floor cleaning chemicals accessible in kitchen area. Administrator immediately corrected issue and stored cleaning chemicals in cabinet in kitchen inaccessible to children in care. A technical assistance citation issued. Carbon monoxide detectors were observed and are operable. All kitchen areas/food preparation areas and food storage areas are kept clean and are free of litter, rubbish, rodents, and/or any other vermin. All storage containers for solid waste, including moveable bins have tight-fitting covers that are kept on, and in good repair. Trash cans used to discard food have tight fitting lids or solid waste bags shall be discarded immediately after each meal.

During inspection, LPAs noted the following regarding the outdoor play area: one outdoor play structure broken with pointed shards of plastic, a mound of cement located near the garden area by the shade structure, and gated fencing around outdoor play area with 2 holes – one by the corner and one in the middle portion of the fencing. A type B citations issued. There is adequate shade in the play yard. LPAs advised that no children shall be left without the supervision of a teacher at any time. There are no firearms stored on the premises. There are no pools or bodies of water at the facility.

Per administrator, no children enrolled in facility at time of inspection. Thus, no children’s records reviewed. Per staff record review, LPAs inspected the following documentation in staff’s file: Education, LIC-501: Personnel Record, LIC 508- Criminal Record Statement, LIC 9052- Employee Rights, LIC 503- Health Screening, Proof of immunization against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse and current Mandated Reporter Training Certificate. During staff file review, LPAs observed that staff files were incomplete. A technical assistance citation issued and LPAs will conduct another follow up visit to ensure complete staff files and documentation prior to facility opening.

LPAs advised administrator that at least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities. The name of the child care center director or fully-qualified teacher(s) designated to act in the director’s absence has been reported to the Department. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day.

Adminsitrator was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP
LPA referred licensee to the Department website for lead: Lead Toxicity Prevention and Water Testing Information.

LPA discussed the safe sleep regulations with administrator and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed administrator of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

This facility does not provides Incidental Medical Services – IMS. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. Administrator was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.
