An unannounced inspection was conducted by Licensing Program Analysts (LPA) Staicy Perry on June 28,2024. A COVID risk assessment was conducted. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 06/26/2024. LPA met with Site Supervisor Carolina Ramon to whom the purpose of the inspection was announced. Census was taken and LPA Perry observed 20 children and 6 staff present.

Throughout the course of the investigation, interviews were conducted with staff and reporting party. LPA also reviewed and obtained copies of the facility roster, ouch report, personnel report and parent handbook and other documentation.

Per initial complaint report, the complainant reported that Staff did not ensure adequate care and supervision was provided and child sustained an injury while in care. Per complainant, C#1 had a child

bite on his left cheek. The RP stated that C#1's cheek was bleeding from where the bite mark happened. The RP stated that the incident occurred at 10:00AM at the facility. The RP stated that they do not pay attention to the children and don't know why. Per interview with R.P. it was stated that C#1 was not bleeding but bite mark on check had the teeth indentations and was red like if there was trapped blood and also bruising. R.P. stated that “I don't feel comfortable that my child is not being taken care of properly and observed properly. The teachers didn't see what happened.”.

LPA conducted interviews with staff # 1- 5. Regarding allegation #1 and #2: Staff #1-5 stated that they did not observe the incident occur. S#3 stated that they were near where the incident happened but was assisting another child in another area. S#4 stated that they were near the table but their back was towards C#1. S#5 stated that they were in the diaper changing area changing diapers. Staff disclosed that there were 10 children with 3 teachers during the time of the incident. Per S#1 who was in classroom B, all S#1 heard was C#1 crying then saw S#3 come to the kitchen to grab ice or an ice pack and then S#3 went back to Classroom A. Per S#2, they were not in the classroom at the time of the incident. All staff corroborated that they did not see the incident occur.

LPA Perry observed where each teacher was positioned when the incident occurred and was evident that no teacher saw what happened. LPA did observe that diaper changing area is inside the restroom which has walls and does not allow visual of the classroom.

This agency has investigated the complaint alleging, Staff did not ensure adequate care and supervision was provided and day-care child sustained unexplained injuries while in care. Based upon the evidence as presented above, the allegation has been determined to be substantiated. Based on interviews and disclosures made during the department investigation, the preponderance of evidence and the standard has been met, therefore, the above allegations are found to be substantiated. California Code of Regulations (Title 22 Division & Chapter), are being cited on the attached deficiencies page LIC 9099-D.

A Notice of Site Visit was provided and must be posted for 30 days. Appeal rights were provided and explained to Site Supervisor, Carolina Ramon. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview was conducted and report was reviewed with Site Supervisor, Carolina Ramon.
