Licensing Program Analyst (LPA) R. Derraco conducted an unannounced case management inspection to the above facility on 02/15/22. LPA arrived at the facility at 09:45 AM and met with licensee Patricia Oseagura, who guided analyst on a tour of the facility. Also present during this inspection was an A2 and A3. Per Licensee, there are no children that are currently enrolled. Licensee states that she currently cares for her two grandchildren. Both grandchildren live in the home with licensee. There was one child present upon arrival.

This is a two story home which consists of 4 bedrooms, 2 bathrooms, kitchen, dining room, 2 living rooms, a detached garage, a laundry room, front yard and backyard (fenced). LPA observed an off limits living space above the garage. The living space consists of a living room, one bedroom and a bathroom. Per licensee, the living space is occupied by her mother in law. Per licensee, the living space is part of the home's address however there is a separate entrance to the living space. Off limit areas include all four bedrooms, one bathroom, kitchen area, laundry room, upstairs living room, backyard, detached garage and living space built on top of the detached garage.

The main care area is located in the downstairs living room. LPA observed two leather couches, a leather chair, ceiling fan, wall mounted television, a locked fireplace, an air conditioning unit mounted in the window, and age appropriate toys. LPA observed the dining area to have a raised dining table and chairs. Per licensee, she plans to install a baby gate between the dining area and the kitchen making the kitchen inaccessible. Child locks were observed beneath the kitchen sink and kitchen cabinets making contents inaccessible. No sharp objects such as kitchen knives were observed to be accessible in the off limits kitchen area. The bathroom designated for use by children was observed to be clean and free of defects. LPA observed a lock beneath the bathroom sink making the contents inaccessible. LPA observed the outdoor play area to have perimeter fencing and contain child sized tables and chairs. appropriate toys have been put into storage due to low attendance . LPA observed some age appropriate toys in the front yard play area.

Individuals who reside in the home were noted and discussed. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. All adults present in the home have obtained a criminal record clearance or exemption prior to working, residing or volunteering in the licensed childcare home. Licensee states that there are firearms stored in an off limits bedroom however licensee does not have access to the safe. Per Licensee, ammunition and firearms are locked separately in a safe box. LPA observed the safe used to store firearms to be locked. There is telephone service via a cellphone that is used and the cellphone stays at the facility during operation hours. LPA observed a wall heater in the off limits hallway to have a cover making the unit inaccessible. Detergents, cleaning compounds, and other items which could pose a danger to children were observed to be kept outdoors in the off limits laundry room. The valve on the 3A 40BC fire extinguisher indicates fully charged and was serviced on 09/08/21 as indicated on service tag. Smoke and carbon monoxide detectors were tested and are operable. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs. No bodies of water were observed on the premises. LPA observed a pet dog in the off limits back yard area.

The licensee has completed training on preventive health practices including Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR expires on 07/2023. LPA observed that the licensee does not have proof of the Mandated Reporter AB 1207 compliant Child Care Training Certificate on file. Parent’s Rights Poster and the Facility License were observed to be posted. LPA advised licensee to post the Emergency Disaster Plan (LIC 610A) as part of the required postings. Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home. (page 2 of 3)

Incidental Medical Services (IMS):
IMS was discussed with licensee. Per licensee, there are no children enrolled that require IMS at this time. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm.

LPA advised the licensee to access forms, regulations and quarterly updates online at: www.cdss.ca.gov. LPA also discussed and provided the Provider Information Notices (PINS) on Recently Approved Safe Sleep Regulations in Effect: PIN 20-24-CCP, Licensee, Assistant, and Children's File checklist, Infant sleep chart, Emergency Disaster Plan (LIC 610A).

Prior to going back to active status, the following correction will need to be observed:
-Mandated Reporter AB 1207 compliant must be completed
-Licensee's immunization records showing measles, pertussis and negative TB test must be kept on file at the facility
-Emergency Disaster Plan (LIC 610A) must be completed and posted in the facility.
-An updated facility sketch (LIC 999) must be completed showing areas to be used for child care and areas that are off limits.
-A gate at the entrance of the stairs making the 2nd floor inaccessible.
-A gate separating the dining room area and the off limits kitchen area.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted and report was reviewed with the licensee Patricia Oseagura.
