Licensing Program Analyst (LPA) Mireya García conducted an unannounced Case Management inspection due to an incident that was reported to the Department on April 13, 2023. LPA met with Principal, Ricky Lim who guided LPA on a tour of the facility. Census was taken.

The purpose of this report is to address the investigative findings of the unusual incident report that was reported to the Department.

On April 13, 2023, an incident was self reported to the Department via telephone by the facility who reported a parent contacted staff to notify that child #1 had "nail print" marks by the rib cage area.

During the inspection conducted on June 12, 2023, LPA Garcia obtained a copy of the LIC 9040 Children's roster dated 06/12/23, Declaration from witness-Staff #2- signed written statements dated 06/12/23, picture of child #1's right rib cage (where two scars where visible), video disclosure of child #1 and conducted interviews with witness-Staff #2, child #1 and telephone interview with parent #1.

During the course of the investigation, LPA obtained a picture of child #1’s scar of two nail marks in the rib cage area of the body, video disclosure of child #1, copy of the LIC9040 Children roster dated 06/12/23, LIC 855 written declaration statement from witness-Staff #2 dated 06/12/23 and a copies of Staff statements; Staff #1 statement dated 04/20/23, Staff #2 statement dated 4/14/23, Staff #3 statement dated 04/14/23 and Staff #4 statement dated 4/14/23, copy of the certificate of completion 12/10/22 of the California Child Abuse Mandated Reporter Online Training for Child Care Providers (AB1207), and conducted interviews with Principal, witness-Staff #2, child #1 and telephone interview with parent of child in question.

During interviews conducted with witness-Staff #2 confirm that on April 12, 2023, during carpet activity child #1 was sitting on carpet and then moved to another area and began to pull items from bulletin board display. Child #1 continued to pull on items after witness-Staff #2 instructed child to stop. Child was then removed from the carpet area by Staff #1 and was seated in classroom chair. Witness confirm Staff #1 removed child #1 by grabbing child from the rib cage area. During interview with Child #1 disclosed Staff #1 grab child. Child #1 demonstrated to LPA how staff #1 grab child during interview child lifted shirt and pointed to a scar of two nail marks that were observed by LPA in the rib cage area of child #1’s body. Video footage was obtained. This poses an immediate health and safety risk to children in care. Title 22 Regulation Section 101223 Personal Rights states (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.

The following deficiency is being cited in accordance with California Code of Regulations, Title 22, Division 12, Chapter 1. Please refer to LIC809D for documentation of deficiency cited.

A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). Acknowledgement of Receipt (LIC 9224 form) must be maintained in each child’s file immediately upon receipt from parent. Principal, Ricky Lim was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form (English/Spanish/Chinese).

A notice of site visit was given and must remain posted for 30 days.

Per Principal, a training with Staff #1 was held on 05/01/23 to address inappropriate handling of student and review the following policies; Code of Conduct with students, Code of Ethic, and the Board Rule Reaffirming the Respectful Treatment of All Persons and the LAUSD Discipline Foundation Policy.

In addition, Principal conducted all staff meeting on 05/01/23 to address handling of students a copy of the Agenda was given to LPA during this inspection in order to clear this citation.
