32 | During the course of the investigation, LPA obtained a picture of child #1’s scar of two nail marks in the rib cage area of the body, video disclosure of child #1, copy of the LIC9040 Children roster dated 06/12/23, LIC 855 written declaration statement from witness-Staff #2 dated 06/12/23 and a copies of Staff statements; Staff #1 statement dated 04/20/23, Staff #2 statement dated 4/14/23, Staff #3 statement dated 04/14/23 and Staff #4 statement dated 4/14/23, copy of the certificate of completion 12/10/22 of the California Child Abuse Mandated Reporter Online Training for Child Care Providers (AB1207), and conducted interviews with Principal, witness-Staff #2, child #1 and telephone interview with parent of child in question.
During interviews conducted with witness-Staff #2 confirm that on April 12, 2023, during carpet activity child #1 was sitting on carpet and then moved to another area and began to pull items from bulletin board display. Child #1 continued to pull on items after witness-Staff #2 instructed child to stop. Child was then removed from the carpet area by Staff #1 and was seated in classroom chair. Witness confirm Staff #1 removed child #1 by grabbing child from the rib cage area. During interview with Child #1 disclosed Staff #1 grab child. Child #1 demonstrated to LPA how staff #1 grab child during interview child lifted shirt and pointed to a scar of two nail marks that were observed by LPA in the rib cage area of child #1’s body. Video footage was obtained. This poses an immediate health and safety risk to children in care. Title 22 Regulation Section 101223 Personal Rights states (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.
