Amended report to change findings due to conflicting witness statements and at this time there are no deficiencies cited. Licensing Program Analyst (LPA) Janeth Chavez conducted an inspection regarding the above complaint allegation and to deliver findings. LPA met with Marina Montano, Head Teacher and toured the facility indoors and outdoors. The Director was not present upon LPA’s arrival. However, LPA spoke to the new Director, Ayanna E. Davis via telephone in regards to the nature of the inspection. There are 67 children and 13 staff present. Teacher-child ratio is met. All staff present have obtained a criminal record clearance or exemption as a condition of employment through LAUSD.
During the investigation LPA conducted interviews with staff, children and complainant. Complainant stated that on 05/01/2019 Staff#1 restrained Child#1 down on the ground and then kneeled on top of child's legs for about 2-3 minutes because Child#1 kept running away from Staff#1. Complainant stated that Child#1 was crying and screaming as Staff#1 kneeled on top of child. LPA interviewed Child #1 but there were no disclosures made by Child #1. As per Adult#1, Child#1 is non-verbal. (Report Continues on Next Page 1 of 2)

The facility self reported this incident to the Department via fax on 05/03/2019 indicating that Staff#2 witnessed Staff#1 restrain Child#1 down on the ground and then kneeled on top of child's legs. LPA contacted LAPD and Investigator Ortega stated that the injury report was closed. Based on LPAs observations, interviews conducted and record reviews the above allegation is UNSUBSTANTIATED. Therefore, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore at this time the above allegation is unsubstantiated.

The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

Exit interview conducted with Marina Montano, during which appeal rights were given and explained. A copy of the Appeal Rights (LIC 9058 01/16) was provided. The Licensee’s signature on this report acknowledges receipt of rights.
