Licensing Program Analyst (LPA) Mireya García arrived unannounced at the facility for the purpose of conducting a follow up complaint investigation to deliver findings regarding the allegations listed above. Due to COVID- 19 precautionary measures were taken, licensing staff present during inspection wore appropriate personal protective equipment. LPA met with Principal, Emily Hooks who guided LPA on a tour of the facility. There were forty-six (46) children observed to be present at the facility during LPAs arrival.

Information provided by the complainant alleges that there is Neglect/Lack of Supervision and facility is not following Reporting Requirement.

During this investigation, LPA Garcia obtained a copy of Children’s rosters dated 08/10/22 & 10/14/22, and conducted interviews with Principal, seven (7) day care staff, child in questioned and one (1) daycare parent.

Pertaining to the allegation of neglect/lack of supervision, interviews conducted with Principal determined an incident occurred on July 19, 2022 where child #1 was injured while in care and as a result received medical care for injury on August 5, 2022.

Statements from child #1 and parent of child #1 confirm that the incident took place at the facility. Parent disclosed receiving documentation the notice of first aid on 07/19/22 from the facility regarding child #1 sustained injury while at the facility on 07/19/22. Parent disclosed taking child #1 to get medical care days later due to child complaining a few times about arm hurting.

Child #1 disclosed while running at school child fell on his hand. Child #1 disclosed staff #3 and staff #7 were outside when child fell and child #1 told staff #3 of the fall. Staff providing care and supervision disclosed not observing or having any knowledge of child #1 being injured while in care, this poses an immediate health and safety risk to children in care.

During this investigation Principal reveal that staff #1 has had issues in the past with lack of supervision due to staff #1 being on the phone during the care and supervision of napping children.

In review of records, on 08/10/22, LPA Garcia reviewed the incident/injury log binder and no incidents were documented for child #1, specifically the incident that occurred on 07/19/2022.

On 09/13/22, LPA Garcia obtained a copy of a Notice of First Aid dated 07/19/22 that was provided to parent #1 by the facility. The document indicates that child #1 hurt their right knee and left arm when child fell while playing during outdoor play and an ice pack was provided to child #1. The Notice of First Aid was signed by staff #7.

Regarding to the allegation of facility is not following Reporting Requirement, interviews conducted with Principal determined an incident occurred on July 19, 2022 where child #1 was injured while in care and child #1 received medical care days later. During this investigation Principal reveal that staff obtained a copy of Notice of First Aid document dated 07/19/2022 from parent #1 and later discovered that child had a cast on left arm as a result of injury. Principal did not report this incident as required to the Department.

Based on LPAs observation, interviews which were conducted, and record reviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiencies are being cited (see attached 9099D).

A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). Acknowledgement of Receipt (LIC 9224 form) must be maintained in each child’s file immediately upon receipt from parent. Principal, Emily Hooks was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form (English/Spanish) was provided to the Principal.

A notice of site visit and a copy of this report was given and must remain posted for 30 days.

Per Principal, she will provide training to all staff in regards to the responsibility for providing care and supervision to ensure staff use active supervision strategies and following Title 22 Regulations and will then submit the training agenda, materials and staff sign in attendance for the training to CCLD by or before 10/14/22 in order to clear this citation.
