32 | When interviewing staff, Staff #1, #2, #5, #6 and #7 stated that Staff #3 does make the children run. Staff #2 disclosed that Staff #3 makes the children run as a form of exercise. Staff #1, #2, and #7 disclosed that Staff #3 has made inappropriate comments about Child #1 in the presence of Child #1 and that Staff #3 does have Child #1 either sit or play in an area away from other children or away from Staff #3. Staff #1, #2, #5, #6 and #7 disclosed that Staff #3 only allows children to drink water inside.
When interviewing Staff #3, Staff #3 disclosed that they do make the children run but, as a form of exercise. Staff #3 further disclosed that children do not drink water outside because they prefer to give them fresh water inside in this manner they are not drinking water on the sand and getting dirty. Staff #3 disclosed that they believe Child #1 may need developmental services and at times includes Child #3 in the classroom activities and at other times lets Child #3 play on their own.
When interviewing children, Child #3 and #4 only disclosed that Staff #3 makes them run, however, they cannot have drinking water outside.
Based on LPAs observations and interviews which were conducted and record review, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 Chapter 1 Personal Rights 101223(a)(1) and 101223(a)(3), are being cited on the attached deficiencies page.
A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee/Director was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee/Director.
The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
