An unannounced complaint visit was made on this day by Licensing Program Analyst (LPA) Shandra Powell to deliver findings of the above allegations. At the time of arrival LPA counted children in all classrooms. 45 children were in attendance.

During the course of investigation LPA made observations, conducted interviews with Director, Staff, and Parents, documentation was also collected. Per complainant, allegation #1 - Facility discriminated against child because child was turned away from attending school for not taking a COVID-19 Home Test at the school vs. at home. Per Director new COVID-19 rules and regulations were set in place to keep children and staff safe during the pandemic. Allegation #2 - Staff failed to protect child from being hit by another child.

Director gave LPA a copy of written documentation explaining new procedures regarding COVID-19 when a person in the facility has tested positive for COVID-19 and Home Quarantine, which was sent to all Authorized Representatives of children enrolled in the facility via Clalss DoJo App on January 24th 2022.

Director denied discriminating against any child in care. Parties interviewed made no disclosures regarding the above allegations "facility staff discriminated against child" and "staff failed to protect child from being hit by another child".

Based on LPA's review of records and interviews concluded the preponderance of evidence standard has not been met, therefore the above allegations are found to be Unsubstantiated.

A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

An exit interview was conducted with Olivia Calleja, Director and Notice of Site Visit was provided with Appeal Rights. The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
