Due to Safer at Home order issued by California State Governor Newsom, on 11/10/2020 at 2:31 p.m., Licensing Program Analyst (LPA) Antonio Almanza conducted a Tele-Conference with the Owner/Director Peggy Nairn, for the purpose of concluding the investigation into the aforementioned allegation, complaint number 30-CC-20200818100308. During today’s Tele-Conference there are 17 children and 5 adults in the Child Care Center. During the course of the investigation, LPA conducted interviews, obtained evidence and made observations in regard to the above allegations.

The parent of Child 1 (C1) is reporting that on 08/07/20 while on their way home from the Child Care Center, the parent observed C1 in the back seat of the vehicle displaying abnormal behaviors. When the parent questioned C1 about the behavior, C1 reported that C1 was inappropriately touched by another child at the Child Care Center. Parent stated C1 was unable to tell when or where the incident happened, but the parent thinks it may have happened in the restroom.

The parent of C1 questioned C1 for approximately 45 minutes and C1 went on to report that while on the playground another child went up his shorts. The parent was unable to get C1 to provide a date or time for the two incidents.

The preschool staff are reporting that children are always supervised while conducting daily activities. When children are playing outside and need to go to the restroom they are escorted to the restroom and supervised by staff. When staff need assistance with supervision, they request assistance from other available staff via walkie talkie. The facility staff are denying knowledge of the alleged incident involving C1. Staff are reporting that they do recall C1 but do not know or witnessed any incident that may have happened to the child relating to the allegation.

On 08/21/2020 and 11/09/2020, LPA Almanza toured the Child Care Center. LPA observed the Child Care Center to be within ratio and observed staff throughout the facility. LPA observed children engaged in classroom activities. LPA observed 2 toilets and 2 sinks and no door in the entrance of the restroom (Pooh-Bear Classroom). The playground has an open space layout with tubular iron bars around the perimeter. LPA reviewed staff and child sign in sheets for the time period in which the allegation may have occurred and observed that the facility was staffed and maintained ratios. During the week that the incident may have occurred, the facility had an average of 6 staff present and is licensed with a capacity of 25 children.

Based on the evidence obtained over the course of the investigation the department was unable to corroborate the allegation. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

There are no deficiencies being cited during today’s visit. An Exit Interview was conducted, a copy of this report, Notice of Site Visit, and Appeal Rights were explained and emailed to the Owner/Director Peggy Nairn. It has been explained that a reply to the email shall be considered a substitute for the hard-copy signature.
