Personal Rights - Staff failed to keep the playground sandbox free from animal feces.

Licensing Program Analyst, V. Wheatley conducted a Tele-visit (virtual) inspection via Facetime with the licensee and director Jennifer Richards on Septmeber 4, 2020 at 3PM. The inspection was regarding the above allegation. The center is operating from 8am to 4pm, Monday through Friday. LPA observed the outdoor play area which includes a large sand box. LPA asked the licensee to walk around the sand box with the camera on the cellphone. LPA observed the sandbox full of sand and did not observe any animal feces.

The licensee denied the allegations and stated the yard is inspected every morning by staff before the children go outside to play. LPA interviewed staff members who admitted animal feces has been observed in the sandbox. Based on the LPA's investigation and interviews which were conducted, the preponderance of evidence standard has been met, the above allegation is substantiated.

A copy of report and a copy of appeal rights is being submitted via email due to Covid-19. The report is being sent to the licensee/director with a read receipt.

Personal Rights-(a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment.

The licensee met with the staff regarding ensuring the yard is checked and cleaned several times a day. Licensee has created a daily outdoor schedule for the yard and sandbox. It requires intials or signature. Licensee will submit a copy of the the schedule to the department.

This requirement is not met as evidenced by interviews which were conducted. Staff admitted that animal feces were observed in the sandbox during children's playtime. Although the sandbox is cleaned daily, on one occasion the feces was observed on a child's shoe. This poses a potential Health & Safety risk to children in care.
