Licensing Program Analyst (LPA) Jesse Sims conducted an unannounced annual random inspection. The LPA met with licensee Norma Estrada who guided the LPA on a tour of the facility. Also present today is assistant Denisse Rojas. Upon entry to the facility the LPA observed two children in care.

The operating hours are Monday through Friday from 7:30 am to 6:00 pm. The day care home provides snack, lunch, dinner and another snack depending on the children's schedule. Children eat breakfast before arrival, however licensee asks children if they have had breakfast and if not she will serve them, breakfast and will remind parents to feed them breakfast before arrival. The licensee provides children transportation to and from school. The licensee has a valid drivers license which expires 10/31/2022 and valid vehicle insurance which expires 09/25/2020.

The facility/home is a single story single family home which has a family room, living room, kitchen, dinning room, three bedrooms, and three bathrooms. Main care is provided in the family room and the connected bedroom. Children use the bathroom located in the hallway. The rest of the home is off limits. The backyard is used for outside play. There is a gated off portion in the yard where the previous guest house was. The guest house has been removed. The area inside of the fencing is inaccessible. Licensee stated that she will contact and inform Licensing if any construction is to begin.

The home was inspected inside and out for safety, comfort, cleanliness, telephone service, heating and ventilation, inaccessibility to poisons, detergents, cleaning compounds, medicines, and hazardous items that can pose a danger to children. Cleaning chemicals are kept on a high shelf, with a safety lock, in the hallway next to the laundry room, inaccessible to children. There are age appropriate toys, both for merely play and educational, as well as, age appropriate equipment on the premises. Per the licensee there are no weapons or firearms of any kind in the facility at this time. This LPA did not observe any weapons. There is a fire place located in the off limits living room which is properly screened. There are no bodies of water on the property.

The First Aid kit was observed and complete. The required fire extinguisher (2A10BC) is fully charged. There are smoke and carbon monoxide detectors were tested and are in operable condition. Fire and disaster drills are conducted monthly and logged with the last drill held on 11-4-19. Licensee and assistant's Pediatric CPR and First Aid certificates expire on 08/2021. Licensee completed a new mandated reporter training on 8/2/19 and assistant completed Mandated Reporter training on 03/29/2018. Licensee and assistant had complete immunization records and file.

The facility annual fees are current. Licensee had all the required posted documents: Facility License (LIC 203), Notice of Parent's Rights Poster (PUB 394), Emergency Disaster Plan (LIC 610A), and Earthquake Preparedness Checklist (LIC 9148). The LPA observed a current child roster. Child files were found to be complete.

The outside backyard is used by the children for outside play. The backyard is gated all around. The outdoor play area was inspected and was observed to be free of hazards, loose and sharp parts with plenty of age appropriate toys.

The following were discussed: There is no smoking permitted during the operating hours. Infant walkers, Johnny jumpers, bouncers, exersaucers and any other item that falls into that category are not permitted in the facility. The LPA also discussed earthquake safety and necessity of drills, required forms for children’s files, facility files and posting requirements and penalty.

The licensee was informed that all adults living in or having access to the home are required to have fingerprint clearances with Department of Justice, FBI and Child Abuse Index prior to having contact with children. If the aforementioned is not adhered to, a Civil Penalty of up to $500, per non-cleared adult will be assessed immediately. Please advise your analyst of any person who will be visiting regularly or for longer than 1 week.

Beginning on January 1, 2018, Assembly Bill 1207 (2015) requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Applicants must meet requirements as a precondition to granting of license of operation. New employees shall have 90 days from date of employment to complete training as required. Please be mindful of the following safe sleep best practices:

• Always place infants on their backs for sleeping

• Use only a tight-fitting sheet on the crib or play yard mattress

• Do not hang any items from the crib or above the crib

• Keep all items, including blankets, out of the crib or play yard

• Pacifiers may be used as long as they do not have items attached to them

• Infants should not be swaddled or have any items covering them while sleeping

• The temperature of the room should be comfortable enough for an adult to wear a t-shirt and not be too hot or too cold

Note: the above guidelines are recommendations for best practices only, until regulations are approved and adopted.

Licensee was advised of the requirement to report unusual incidents and/or injuries to the parent/guardian and Licensing within the time frame specified by the regulation (call within 24 hours and submit the form within 7 days) and on the form LIC624B. The "Notification of Parent's Rights" poster must be posted in an area of the home accessible to parents. The information regarding new legislation with regards to exemptions and Parent’s Rights was also discussed.

Licensee was advised that the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. If this requirement is not met, civil penalties in the amount of $100 per violation will be assessed.

The facility was in compliance per Title 22 regulations no deficiencies were cited during today's inspection. An exit Interview was conducted, a copy of this report and a Notice of Site visit were provided to the licensee Norma Estrada.
