Licensing Program Analyst (LPAs), Denise Miranda and Lilia Hernandez , conducted an unannounced case management inspection on 01/24/2023 at 9:31AM. LPA met with Vinodhini Veerasingam, Administrative Assistant, Director, who guided analyst on a tour of the facility. There were 26 children being supervised by 10 staff.

The purpose of the visit is to follow-up on a previous case management visit that was conducted on 01/18/2023. LPA Miranda conducted an initial visit on 01/18/2023 to follow-up on the self-reported incident in which Staff #1 discovered Child #1 not breathing while performing a sleep check. On 01/18/2023 LPA Miranda took pictures, obtained copies of documentation, reviewed records, and made observations that are not in compliance with Title 22. LPA Miranda is addressing the non-compliance observed on 01/18/2023 on today’s case management due to the facility closing at 5:30PM and LPA was unable to complete the initial follow-up report.

On 01/18/2023 LPA Miranda observed that Staff# 3,#5, #6, #7, #8, #9 and #10 not having a criminal record clearance or criminal record transfer, a civil penalty of $3,500.00 is being assessed during today’s visit. Individuals without a criminal record clearance, exemption, or transfer who are present while children are in care poses an immediate health, safety, and personal rights risk to children in care.

Director that prior to working or volunteering in a licensed facility, staff need to have a criminal record clearance, criminal record exemption, or request a criminal record transfer.

While inspecting the sleep area on 01/18/2023 in Room Toddler C, LPA Miranda observed that Staff #6 was singularly caring for 7 infants. In interviewing staff, Staff #10 confirmed that they left Staff #6 to singularly care for the 7 infants due to Staff #10 leaving for a 1-hour lunch break. On 01/18/2023 LPA observed that 3 infants were awake in Room Toddler C and 4 infants were napping in the nap area. There is a half wall in Room Toddler C, however, the second half of the wall is covered with a black curtain which prevents not just physical but also visual supervision (pictures were taken).

When inspecting Infant Room A (Child #1s classroom) on 01/18/2023, LPA observed that the lights in the nap area were not coming on when flicking the light switch. LPA was informed that the light switch indeed does not work. The only way LPA Miranda was able to inspect the nap area in Infant Room A was by Staff #1 turning on a cell phone flashlight and walking with LPA and obtained photos. LPA took pictures of the cribs in the nap area to observe that the cribs in Infant Room A were placed side by side without providing a walkway and workspace between the cribs.

While reviewing facility records on 01/18/2023, LPA observed that the infant sleep log for Child #1 was not updated. Staff #1 and Staff #2 confirmed that the log was not up to date on safe sleep log 01/18/2023. Also, LPA observed that Classrooms Toddler A, B and C were not documenting the napping time on safe sleep log.

While inspecting two other classrooms, Toddler Room A and Toddler Room B, LPA observed that the facility is using the classroom play space as the nap area. LPA informed the Director that the nap area needs to be separate from the indoor play area.

Base on observation interviews, and supportive documents, records reviewed, pictures taken it has been determined that the facility has violated Child Care

A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). Director was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form (LIC9224) during this visit.

Indoor Activity Space for Infants:
