Licensing Program Analyst (LPA) Denise Miranda conducted an unannounced 3 year required site inspection to ensure the health & safety standards as required by regulations governing family child care homes are being met. LPA met with David Frank, Licensee/Director. LPA inspected the inside and outside of the facility. All center staff that were present during today’s inspection had fingerprint cleared and associated to the designated license number.
Upon arrival at 12:15pm.
LPA observed a total of 21 children and 4 teachers, 1 teacher assistant and Licensee were present during the inspection. LPA reviewed the facility’s sign in and sign out sheets to verify the census. At 12:20pm, LPA inspected the preschool classrooms center. LPA toured and inspected the preschool in accordance with the facility sketch.

All furniture and equipment were inspected for age appropriateness and good repair. Telephone service, heating, lighting and ventilation were evaluated. LPA observed individual cubbies for children's belongings. The Director office as an isolation area when children are sick.

The bathroom and toileting areas were inspected, LPA observed adequate toilets and sinks to accommodate the facility’s capacity. Toilets flush properly, toilet and sinks are reachable by the children in care. The restroom has adequate toilet paper and paper towels available. The bathroom was found to be clean. There is adequate lighting/ventilation in the bathroom area. Facility inspected one bathroom. Bathroom: has 3 sinks and 3 toilets located inside of the premises.

Requirements for fingerprint clearances and associations were discussed with the licensee. Licensee can be cited a civil penalty of $100 per day, up to $500.00 (5 days) for the 1st offense and up to $3000.00 for the 2nd offense within a 12-month period. The licensee was advised of the requirement to report unusual incidents and/or injuries to the parent/guardian and licensing within the time frame specified by the regulation. The "Notification of Parent's Rights" (PUB394) poster must be posted in an area accessible to parents. The information regarding new legislation with regards to exemptions and Parent’s Rights was also discussed.

The licensee was informed of The Child Care Advocate Program (CCAP) that is administered from within the Community Care Licensing Division. CCAP participates in many community activities and special projects in order to disseminate information on the State’s licensing role, provide information to the public and parents on child care licensing, and provide many other helpful resources to the licensees and the public. AB 1207: Beginning January 1, 2018, this law requires all licensed providers, applicants, directors and employees to complete training no later than 3/30/2018 as specified on their mandated reporter duties and to renew their training every two years. Volunteers are encouraged but not required to take the training. Website: www.mandatedreporterca.com.
Senate Bill 792: Commencing September 1, 2016, prohibits a person from being employed or volunteering at a child care facility or family day care if he or she has not been immunized against influenza, pertussis and measles.
New Immunization Requirement: Law enacted by SB 277, beginning January 1, 2016, personal beliefs exemptions will no longer be an option for the vaccines that are currently required for entry into child care or school in California. Personal beliefs exemptions already on file will remain valid until the child reaches the next immunization checkpoint.

Licensee was made reminded that it is the licensee’s, as well as anyone who assist in providing care responsibility to know the regulations. Licensee was advised on how to access quarterly reports, forms, and regulations for Child Care online at www.ccld.ca.gov. Licensee was also encouraged to read the Child Care quarterly updates every season as they come out to stay informed of any changes or updates to statutes and regulations. LPA recommended to assistant Director to review the title 22.
During this inspection, LPA also provided the following documents about 1) California School Immunization Record form CDPH286, 2) California Law – Car Seat by California Department of Public Health 3) AB 2084 (Brownley) - Health Beverages in Childcare by California Center for Public Health Advocacy California Food Policy Advocates and 4) PUB269 California Child Passenger Safety Law and title 22 - 101227 Food Services.

The facility was found no to be in compliance per Title 22 regulations, cited today 08/30/2019 (please see LIC809D).

Parent's provide lunch daily and snacks for their children. The center will provide snacks as a need. LPA observed the menu. Water is available inside the classrooms. Teachers also take a pitcher of water and cups outdoors.
Smoke detectors, carbon monoxide and fire extinguishers were observed.
LPA observed floor mats for napping.
The last fire drill was conducted on 4/3/2019.
LPA observed Teachers with currently certified in pediatric first aid and Mandated Reporter.
LPA observed cleaning supplies are storage out of reach to the children.
Inspection of the outdoor play area was conducted play equipment are securely anchored. All areas are adequate resilient cushioning and free of hazards. Drinking water is readily available on the outdoor play space. There is adequate shade for the children in care. There is appropriate fencing around the perimeter of the outdoor play area.
First Aid supplies were stored appropriately area inside the classrooms and director office’s required postings were observed by LPA.

Incidental Medical Services (IMS) policy was discussed. For IMS information, see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Incidental Medical Services Include: Blood-Glucose Monitoring for Diabetic Children, Administering Inhaled Medication, Administering EpiPen Jr. and EpiPen or other Epinephrine Auto-Injectors, Glucagon Administration, Gastrostomy Tube Care (G-tube care), Insulin Injections Administration, Anti-Seizure Administration, and Emptying an Ileostomy Bag. The ADA requires that child care providers not discriminate against persons with disabilities on the basis of disability, that is, that they provide children and parents with disabilities with an equal opportunity to participate in the child care center's programs and services.
At 1:46pm, LPA observed Children and staff records were reviewed during the inspection.
The following was discussed: Mandatory Forms for the children’s files and staff’s files, Requirements for disaster drills and documentation for both. Role and responsibilities of being a mandated reporter were discussed. The licensee was advised how to access forms and Regulations for Family Child Care online at www.ccld.ca.gov.
Licensee was made aware that it is their responsibility to know the regulations as well as anyone who assists in providing care. Licensee was advised on how to access quarterly reports, forms, and regulations for Child Care online at www.ccld.ca.gov. The licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care. Licensing must have the facility’s phone number at all times; if the phone number is changed, licensing must be notified. Regulation prohibits the smoking of tobacco on the premises.
LPA disclosed about personnel requirement for volunteer, title 22 101216, that the licensee may volunteers provided that such volunteers are supervised and are not included in the center's staffing plan.
The following child care center personnel shall be at least 18 years old:Persons who supervise employees and/or volunteers. Persons, including volunteers, who provide any element of care and supervision to children.
